DEVELOPMENT AGREEMENT - ECHO RIDGE ADDITION <br /> <br />II <br />GENERAL <br /> <br />1. Pork D¢clication Requirements: Park dedication shall be satisfied in cash in the amount of <br /> Three Hundred Fifty Dollars ($350.00) for Lot 2, and Lot 3, Block 1 of Echo Ridge. The <br /> park dedication shall be provided to the City prior to the recording of the plat. No park <br />dedication for the remainder of the plat is required at this time. However, the future development <br />of the plat will require additional park dedication. <br />2. Requirements for Building Permits: No building permit for any lot in the Plat shall be <br /> issued until (a) vehicular access to the lot is provided including the installation of Class 5 <br /> material on 177th Avenue N.W.; (b) a Certificate of Survey including that information <br /> required by the CITY has been supplied to the Building Official and the financial <br /> guarantees required by paragraph under Stage I Improvements has been satisfied. <br />3. Recorcling of Contract: The DEVELOPER agrees that this Development Agreement shall <br /> be recorded in the office of the Anoka County Recorder and agrees that the terms and <br /> provisions of this Agreement shall be a covenant on any and all deeds relative to the <br /> property included in the Plat. <br />4. Tree Disease Prevention: The DEVELOPER shall prevent the introduction and spread of <br /> tree disease into the residue tree populations of the Plat and adjoining properties and reduce <br /> the impacts of construction on the residual property of the Plat and adjoining properties. <br /> The DEVELOPER in order to accomplish this shall: <br /> <br /> a. Install physical barriers such as snow fence or string with ribbon, etc. around trees <br /> that are to remain (the fencing will be at least ten feet (10') from these remaining <br /> trees); <br /> b. Insure that all equipment operators will have readily available tree wound dressing <br /> and will apply immediately to damaged trees if wounding occurs; <br /> c. Insure that trees will only be skidded against other trees that are to be removed. <br /> Trees in the middle twenty feet (20') of road easement will be removed first, with <br /> remaining n'ees to be skidded toward the middle of the road easement. <br /> <br />5. Dumping of Garbage: The DEVELOPER shall adhere to City Ordinance No. 89-11 <br /> which is an Ordinance Regulating the Dumping of Garbage, Site Development and <br /> Construction Debris. <br />6. Reimbursement to City: The DEVELOPER agrees to reimburse the CITY prior to <br /> recording of the Final Plat, for ali costs incurred by the CITY in defense or enforcement of <br /> <br /> <br />
