10. <br /> <br />11. <br /> <br />12. <br /> <br />~ Fire lanes shall be maintained on the Site. The exact location of these <br />items on the Site shall be as directed by the City's Fire Chief. <br /> <br />MUNICIPAL SEWER AND WATER. The Permittee agrees to connect to City sewer <br />and water at the time sewer and water is extended to the area and herein agrees to join in a <br />petition for such improvements when such petitions are presented. <br /> <br />BITUMINOUS PARKING SPACES. The Permittee shall provide eight (8) <br />bituminous surfaced parking spaces, including one handicap space, for employees and <br />customer parking. <br /> <br />I.~[.GiI.TI,~LG~ Any lighting installed on the Structures or in the parking lot shall be <br />designed so as to deflect light away from 142nd Avenue N.W. <br /> <br />REOUIREME1NTS FOR BUILDING PERMIT. No building permit for the site will <br />be issued until: 1) the southerly half of 142nd Avenue N.W. is improved from Jaspar <br />Street N.W. to 160' west of the N.E. corner of Lot 2, Block 1, Gateway North Industrial <br />Park, and 2) Cash or a Letter of Credit is deposited with the City in an amount equal to <br />150% of the City Engineer's estimated cost of improving all of 142nd Street N.W. from <br />Jaspar Street N.W. to Limonite Street N.W. to City standards with the exception of <br />bituminous surface. No Certificate of Occupancy for occupancy of any building on the site <br />will be issued until 142nd Avenue N.W. has been imProved to City standards and accepted <br />by the City except that bituminous surface is not a requirement for a Certificate of <br />Occupancy to be permitted. The Permit Holder herein agrees to join in petitions for all such <br />roadway improvements when such petitions are presented. <br /> <br />IMPROVEMENT CONSTRUCTION SCHEDULE. The Improvements required <br />shall be constructed and installed on or before December 30, 1991. <br /> <br />~ In order to insure the installation of the Improvements in accordance with <br />City specifications and in a timely manner, the Permittee shall be required to deposit with <br />the City a cash escrow or letter of credit approved by the City, in the amount of $13,000, <br />which is $150% of the City's estimated cost of the Improvements. <br /> <br />Upon completion of the construction of the Improvements, as certified by the City <br />Engineer, the escrow shall be returned to Permittee. In the event Permittee fails to <br />construct and install the Improvements as required herein, the City may complete the <br />Improvements with City day labor and/or by letting contracts for said completion and draw <br />upon the escrow for payment. Permittee hereby grants permission and a license to the City <br />and/or its contractors and assigns to enter upon the Site for the purpose of completing the <br />construction and installation of the Improvements in the event of Permittee's default. <br /> <br /> <br />
