10. 11. 12. ~ Fire lanes shall be maintained on the Site. The exact location of these items on the Site shall be as directed by the City's Fire Chief. MUNICIPAL SEWER AND WATER. The Permittee agrees to connect to City sewer and water at the time sewer and water is extended to the area and herein agrees to join in a petition for such improvements when such petitions are presented. BITUMINOUS PARKING SPACES. The Permittee shall provide eight (8) bituminous surfaced parking spaces, including one handicap space, for employees and customer parking. I.~[.GiI.TI,~LG~ Any lighting installed on the Structures or in the parking lot shall be designed so as to deflect light away from 142nd Avenue N.W. REOUIREME1NTS FOR BUILDING PERMIT. No building permit for the site will be issued until: 1) the southerly half of 142nd Avenue N.W. is improved from Jaspar Street N.W. to 160' west of the N.E. corner of Lot 2, Block 1, Gateway North Industrial Park, and 2) Cash or a Letter of Credit is deposited with the City in an amount equal to 150% of the City Engineer's estimated cost of improving all of 142nd Street N.W. from Jaspar Street N.W. to Limonite Street N.W. to City standards with the exception of bituminous surface. No Certificate of Occupancy for occupancy of any building on the site will be issued until 142nd Avenue N.W. has been imProved to City standards and accepted by the City except that bituminous surface is not a requirement for a Certificate of Occupancy to be permitted. The Permit Holder herein agrees to join in petitions for all such roadway improvements when such petitions are presented. IMPROVEMENT CONSTRUCTION SCHEDULE. The Improvements required shall be constructed and installed on or before December 30, 1991. ~ In order to insure the installation of the Improvements in accordance with City specifications and in a timely manner, the Permittee shall be required to deposit with the City a cash escrow or letter of credit approved by the City, in the amount of $13,000, which is $150% of the City's estimated cost of the Improvements. Upon completion of the construction of the Improvements, as certified by the City Engineer, the escrow shall be returned to Permittee. In the event Permittee fails to construct and install the Improvements as required herein, the City may complete the Improvements with City day labor and/or by letting contracts for said completion and draw upon the escrow for payment. Permittee hereby grants permission and a license to the City and/or its contractors and assigns to enter upon the Site for the purpose of completing the construction and installation of the Improvements in the event of Permittee's default.
