CASE #15 <br /> <br /> IMPLICATIONS OF RECENT <br />LANDFILL AND SALES TAX LEGISLATION <br /> <br />By: Sandra Ashley Helling, Acting City Administrator <br /> <br />Background: <br /> <br />A revisor copy of CCRHF0303, A Bill for an Act Relating to Waste Management: <br /> <br />1) places a moratorium on activities related to the siting of mixed municipal solid <br />waste disposal facilities; and <br />2) establishes a replacement siting process which includes representatives from <br />the seven metropolitan counties, in consultation with the metropolitan council and <br />the office of waste management developing a specific process for siting and <br />developing a disposal facility ... unless each county and the council agrees that a <br />mixed municipal solid waste facility will not be needed within the next 15 years to <br />adequately manage metropolitan waste; and <br />3) The counties shall design the siting process to avoid siting facilities where those <br />facilities could have relatively strong negative impacts on aquifers; and <br />4) The counties shall report the proposed process to the legislative commission <br />on waste management by December 1, 1991; and <br />5) The legislative commission on waste management ... shall recommend <br />legislation by January 1, 1992 ... shall make a formal recommendation to either <br />allow the repeal of the existing metropolitan landfill siting process to take effect <br />as scheduled or reinstate that process. <br /> <br />In addition to the legislation involving the landfill siting process, the final tax bill passed by the <br />Legislature (and Governor Carlson is expected to sign) includes the "Local Option Sales Tax" <br />whereby 2 cents of sales tax revenue is to be dedicated to local aids and the sales tax would be <br />increased from the current 6% to 6-1/2%. The League of Minnesota Cities is urging all cities to <br />support their county in the adoption of the local option sales tax. If a county fails to adopt the <br />1/2 cent additional sales tax, the county and its cities and townships would lose ALL of their aids <br />-- LGA. HACA and disparity reduction aid. If the county does not adopt this tax, the sales tax rate <br />in the county would not drop - it would stay at the current 6% and 1-I/2 cents of the sales tax <br />revenue would go into a local government trust as a windfall for all local governments in other <br />counties. <br /> <br />The Anoka County Board of Commissioners plans to consider the ratification of the sales tax as <br />proposed by the State of Minnesota on June 11, 1991.
