Motion by Commissioner Deemer and seconded by Commissioner Bawden to recommend that <br />City Council approve Glenn Rehbein, Inc's. request for a conditional use permit, as amended, <br />based on the findings of fact. <br /> <br />Motion carried. Voting Yes: Chairman Zimmerman, Commissioners Deemer, Bawden, <br />Hendriksen and LaDue. Voting No: None. Absent: Commissioners Terry and Thom& <br /> <br />Case #4: Request to Vacate Dedicated Street Right-of-Way in Gateway North <br /> Industrial Park <br /> <br />Mr. Jankowski stated that a public hearing had been held earlier tonight regarding this case. He <br />feels that the persons proposing this vacation are doing so strictly for economic reasons. He added <br />that on the positive side for vacation, all lots served by the street system proposed to be vacated <br />will continue to have legal access; however, lots along 143 Avenue N.W., Jaspar Street N.W. and <br />the remaining portion of 142nd Avenue N.W. would be serviced by 2100 feet of dead end street. <br />Planning efforts have identified a future outlet to the east for this industrial area but on the negative <br />side, plans aren't always realized. He added that this proposed vacation can attest to that fact. The <br />proposed vacation would cause utilities such as gas, electric, water and telephone which are <br />normally looped to either be decreased in flexibility or require greater costs because of needed to be <br />"doubled back" along the existing route. The proposed vacation would also eliminate the <br />possibility of access for Pioneer Wood Products onto Limonite Street N.W. if in the future, safety <br />consideration dictated County Road #56 have reduced access. He concluded that the existing <br />transportation netowrk is superior to what will exist with the proposed vacation and therefore <br />would recommend the Planning and Zoning Commission fred the vacation not to be in the public's <br />best interest. He added that since the purpose behind the petition is primarily for economic <br />reasons, the Commission may consider recommending denial of the petition along with the <br />recommendation that the developer be released from the agreement to install the portion of the road <br />being petitioned for vacation. He stated that if the developers are not required to install the roads, <br />they may not get done and the development that occurs will accept what is there for them. <br /> <br />Chairman Zimmerman expressed he is in favor of the vacation. <br /> <br />A discussion ensued regarding the thoroughfare plan. <br /> <br />Commissioner Hendriksen stated that the distance from Ramsey Boulevard to the end of the <br />proposed cul-de-sac is 2100 feet and a 2100 foot cul-de-sac is clearly prohibited. He feels there is <br />no incentive for the City to vacate. <br /> <br />Chairman Zimmerman inquired what would happen if the lots got into tax forfeit. <br /> <br />Mr. Jankowski stated the County would sell them. <br /> <br />Mr. Hendriksen stated that if the lots are forfeitted and become owned by the City or the County, <br />they could be put to use to generate tax revenue. <br /> <br />Commissioner Deemer stated that the vacation of Limonite Street N.W. would prevent subdividing <br />of lots and in his opinion, the proposed vacation appears to be a purely financial venture. He could <br />see waiving blacktopping but feels developing the roads to Class Five should be required. <br /> <br />Mr. Jankowski stated that decideing if the street get built or not is up to the City Council. The <br />Planning and Zoning Commission is being asked to determine if the vacation is in the best public <br />interest. <br /> <br /> <br />
