o <br /> <br />NOW, THEREFORE, the CITY and DEVELOPER agree as follows: <br /> <br />IMPROVEMENTS <br /> <br />Access to Lots. All lots in the Plat have access onto 155th Avenue N.W. <br /> <br />Variance. The City hereby grants a variance to the minimum street frontage requirement <br />on Lot 1, Block 1 of the Plat. <br /> <br />The DEVELOPER shall provide, in recordabl, form, a separate document conveying <br />Outlet A to the CITY. Outlet A shall consist of a 66 foot wide road easement along the <br />western boundary of Lot 2, Block 1 from l$Sth Avenue N.W. to that parcel of property <br />lying directly north of said Lot 2 of the Plat. <br /> <br />The DEVELOPER shall provide the CITY with a ropy of the private easement dedicated <br />across Lot I, Block 1, Sibbel Addition, to provide access to the property lying directly <br />north of said Lot i of thc Plat. <br /> <br />Dedication of Drainage and Utility Easement~;. Drainage and utility easements <br />.. shall be dedicated to the CITY as shown on the Final Plat. <br /> <br />II. <br />GENERAL <br /> <br />Park Dedication. Park dedication shall be sattsifed in cash in the amount of One <br />Thousand and Fifty Dollars ($1,050.00) ($350.00 each for Lots 1, 3 and 4 of Block 1) for <br />Sibbet Addition. The park dedication shall be provided to the CITY prior to recording of <br />the plat. No park dedication for the remainder of the plat is required at this time. <br />However, future resubdivision of the plat will require additional park dedication. <br /> <br />Requirements for Building Permits. No building permit for any lot in the Plat shall <br />be issued until (a) the DEVELOPER provides the CITY with a 66 foot wide road <br />easement along the western boundary of Lot 2, Block t; (b) a Certificate of Survey <br />including that information required by the CITY has been supplied to the Building Official. <br /> <br />Tree Disease Prevention. The DEVELOPER shall prevent the introduction and <br />spread of tree disease into the residue tree populations of the Plat and adjoining properties <br />and reduce the impacts of construction on the residual property of the Plat and adjoining <br />properties. The DEVELOPER in order to accomplish this shall: <br /> <br />Install physical barriers such as snow fence or string with ribbon, etc. around trees <br />that are to remain (the fencing will be at lea~t ten feet (Iff) from these remaining <br />trees); <br /> <br />bo <br /> <br />Insure that 'all equipment operators will have readily available tree wound dressing <br />and will apply immediately to damaged trees il' wounding occurs; <br /> <br />c. Insure that trees will only be skidded against other trees that are to be removed. <br /> <br />Dumping of Garbage.
