§ 7.61 issuing or renewing the license. Each pending application for a license shall be approved or disapproved by the City Council. 7.61.03 Location~ Lawful gambling under license issued by the Minnesota Charitable Gambling Control Board may be conducted only at locations that comply with applicable zoning, building, fire, and health codes of the City of R~msey. All applications must be for a specific location with the exception of Class D (raffle only) licenses. The following locations are considered unsuitable for g~mbting operations and any request for a gambling license at such a location will be rejected without clear and convincing evidence that such a location will not pose undue enforcement difficulties, lessen property values of adjoining properties, or expose gambling to persons under 18 years of age: a. Areas zoned for agriculture or residential use; Locations where the predominant clientele is under the age of 18 years of age; 7.61.04 Conditions. The conduct of lawful gambling under license issued by the Minnesota Charitable Gambling Control Board shall be subject to the following conditions in the City of R~rnsey: a. No organization shall be eligible for a g~r~bling license unless, for the three years ~mmediately preceding the date of application, it has demonstrated that during that period it has performed substantial services within the City of Ramsey or on behalf of residents of R~r~sey; b. No more than two bingo occasions each week shall be conducted by any organization. No person who leases premises to two or more organizations for purposes including the conduct of bingo shall allow more than two bingo occasions to be conducted on the premises in any week; c. Gambling locations shall be limited to one licensed gzrnbling organization at any one time in the licensed premises and any rooms; adjoining the prem{ses under the same management. No lease shall be made with one organization while another lease is in effect for the ssme on-sale establist~nent; d. Ever>, agreement between a non-profit organization and a gsmbling location owner for gambling shall be in the form of a written lease. The written lease shall be the complete agreement between the panics, and there shall be no un~-ritten terms or conditions.
