I <br /> i <br />I <br /> I <br /> ! <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> i <br /> I <br /> <br />§ 7.61 <br /> <br />Charitable gambling <br /> <br />no <br /> <br />A copy of any lease agreement between a non-profit organization <br />axed a gambling location owner or operator shall be filed with the <br />City Administrator with the gnmblin~ license application; <br /> <br />A lease agreement between a non-profit organization and a <br />gomhling location owner or operator shall not provide for rental <br />payments based on a percentage of receipt~ or profits from lawful <br />gambling. There shall be no other compensation paid to the <br />gambling location owner or operator, directly or indirectly, other <br />than the rental fee provided in the lease agreement. The <br />maxim,,m rental fee shall be $600.00 per month; <br /> <br />The gambling operations shall be maintained by the organization <br />licensed to conduct gambling and shall be under the exclusive <br />control of that organization. The organization licensed to conduct <br />gambling shall prominently display it~ n~me at the location <br />where the gombling devices are distributed or used and shall <br />indicate the intended use of all profits from gambling; <br /> <br />No employees or agents of the gambling location shall be paid for <br />handling gambling devices, gambling money, prizes, or <br />gambling records; <br /> <br />The organization licensed to conduct gambling shall have <br />exclusive control over all gambling devices, money, and records. <br />Whenever the organization is not present or specifically <br />represented by its agent, all gsmbling devices, money, and <br />records shall be securely locked and shall be inaccessible to <br />employees of the gambling location; <br /> <br />No gambling funds shall be commingled with funds of the <br />gambling location; <br /> <br />No food, drink, or entertainment discounts or other promotions <br />shall be offered in conjunction with the sale of gambling dexfices <br />or chances; <br /> <br />The gambling location shall allow the organization to conduct <br />gambling at any time during its lawful business hours and shall <br />prohibit gambling at any time other than its lawful business <br />hours; <br /> <br />The owner or operator of a gambling location shall make no <br />agreements with any gambling equipment distributor requiring <br />the use of his or her gambling equipment in the establishment; <br /> <br />The City Council may disapprove a gambling license application <br />for an establiskment in wkich g~mbling violations have <br />previously occurred. <br /> <br />7.61.05 Investigation.
