Schroeder, City Administrator <br /> <br />Background: <br /> <br />At the August 27, 1991 meeting, the Council authorized engineering for the Windemere Woods, <br />Cedar Hills, Chestnut Hills and Chestnut Ponds Subdivisions. Subsequently, staff met with the <br />developers of the subdivisions and informed them of the proposed phasing plan for the public <br />improvements and requested submittals of final plats where appropriate and initiation of rough <br />grading by mid-September. These activities are currently being started. In order to afford the <br />trunk water and sewer line portions of the public improvements, there are five parcels of property <br />outside of the developments mentioned above which must be acquired. Therefore, we have <br />included, for your consideration, the resolution which authorizes acquisition of these parcels for <br />utility easements and initiates the condemnation process as part of that authorization. It is the <br />staffs desire to negotiate for the purchase of these parcels, however, the initiation of the eminent <br />domain process is necessary in order to ensure timely completion of the acquisition. At the <br />Council meeting, we will also ask for a motion to authorize appraisals on the property and as part <br />of the eminent domain resolution, the owners are also availed of the opportunity to acquire their <br />own appraisals which will be reimbursed by the City in an amount up to $500 per appraisal. At the <br />time of the writing of this agenda case, we do not yet have quotes for our appraisals and expect to <br />be in receipt of only one by the meeting of September 10, 1991, but expect to receive the second <br />quote by the end of the week. <br /> <br />Recommendation: <br /> <br />Council authorize staff to enter into an agreement with an appraiser with a not-to-exceed number as <br />determined by the Council. <br /> <br />Council Action: <br /> <br />Motion to adopt Resolution g91-09- authorizing an acquisition of permanent and temporary <br />easements. <br /> <br />and <br /> <br />Motion to authorize staff to enter into an appraisal agreement towards acquisition of these parcels in <br />an amount not-to-exceed $. <br /> <br />Review Checklist: <br /> <br />City Administrator <br />Finance Officer <br />City Engineer <br />Project Manager <br /> <br /> <br />
