successors in interest, agrees to indemnify and defend the County of A~oka, city of Anoka, and City of Ramsey and their officials and employees and their joint powers agreement Landfill Board from all liability, claims, actions, costs, losses, expenses, governmental proceedings and investigations, including but not limited to environmental damage, environmental cleanup costs, personal or bodily injury or death, damage to or loss of property, costs of defense, settlement and reasonable attorneys' and other professional fees, that may in any manner result from or arise out of the operation, maintenance, removal, repair, use or existence, in the past or in the future, of the Property transferred pursuant to this document and Easements transferred by separate documents including the breaking of such Pipeline or the leaking of any substance therefrom. The parties specifically acknowledge this indemnification Agreement covers any activities associated with the operation of the methane gas extraction project by the Landfill Board, including any condensate recovered from the Pipeline and returned to the landfill operated by Waste Management. 6. USE CARE AND OPERA'i'£ON OF PROPERTY Waste Management agrees to use the Property in a careful and proper manner and to keep the Property in good repair, condition and working order, until such time as use is terminated and to comply with governmental regulations and manufacturer's instructions relating to the possession, use, maintenance, repair and operation of the Property. 7.
