I

I
I

I

I

I
I

I

I
I

CASE

ON-SALE NON-INTOXICATING BEER LICENSE
FOR GREG MULLER dba RAMSEY PIZZA FACTORY
By: Mike Auspos, Police Chief

Background:

On September 20, 1991 Greg Muller applied for an on-sale non-intoxicating beer license
for his business, Ramsey Pizza Factory, located at 6001 - 167th Avenue N.W. He has
been in business for nine months prior to date of application as a pizza take-out
establishment.

Findings:

On September 26, 1991 Mr. Muller paid the license fee of $200 as required by ordinance.
I have checked the files of the Bureau of ~al Apprehension and there is no showing of
any liquor relaw_xl violations. He has submitted an affidavit declaring that he has not sold in
the previous year over $10,000 worth of beer and will not be doing that amount of
business in his applied for license year. By doing this he does not have to show proof of
liquor liability insurance. The taxes on the property where the business will be conducted
were paid in May of 1991 and are due again October 15, 1991. Mr. Muller leases the
space. He has taken over another lease space adjacent to his pizza kitchen and this is
remodeled as a restaurant for persons to sit and eat. A public hearing has been held as
required by ordinance.

If this license is granted there will need to be a refund made to Mr. Muller on his paid fee
since, if approval is given on October 22, 1991, he will only have eight months until
renewal. The ordinance does allow for pro-rata fees. The amount can be computed by the
Finance Department after approval and will be approximately $133.00 for the remaining
license year.

Recommendation:

Staff recommends that Council approve the issuance of an on-sale non-intoxicating beer
license to Greg Muller dba Ramsey Pizza Factory.

Review Checklist:

Police Chief
City Administrator
City Attorney
Finance Officer
Fire Chief

CC: 10/22/91
