I <br /> <br />I <br />I <br />I <br />I <br />! <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />CASE <br /> <br />REQUEST FOR SITE PLAN APPROVAL; <br />CASE OF BERNIE VEVEA, VE.VE, INC. <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />On September 28, 1990, the City received an application from Mr. Bernie Vevea of Ve-Ve, Inc. <br />for site plan approval to construct a 60'x90' (5,400 square foot) expansion to his existing facility <br />located at 14047 Azurite Street N.W. The existing facility is developed on two lots of record <br />totalling approximately 2.25 acres. <br /> <br />On October 16, 1990, the Planning and Zoning Commission reviewed Mr. Vevea's proposed site <br />plan. The Planning and Zoning Commission recommended site plan approval contingent upon <br />compliance with items contained in the City Engineer's Review Letter dated October 11, 1990 with <br />the following exceptions: <br /> <br />a) <br /> <br />b) <br /> <br />The requirement for 50% other than metal exterior walls was waived in order that <br />the proposed expansion would be consistent with the existing facility. <br /> <br />The requirement for blacktopped and curbed access and parking was waived until <br />such time as Azurite Street is improved, including storm sewer. However, a letter <br />of credit would be required to guarantee construction of the improvements at the <br />appropriate time. <br /> <br />c) <br /> <br />The requirement for submission of building plans certified by an engineer or <br />architect was waived for the Planning and Zoning Commission purposes. <br /> <br />On October 23, 1990, the City Council reviewed the proposed site plan for expansion of Ve-Ve, <br />Inc. At that time, it was noted that the submission of building plans certified by an engineer or <br />acrhitect may be waived for purposes of the Planning and Zoning Commission, but the Building <br />Official cannot waive same and will be requiring certified plans. It was also noted that with the <br />proposed expansion, Mr. Vevea's facility had reached the threshold where an automatic sprinkler <br />system would be required. <br /> <br />At that time, Mr. Vevea doubted that the expansion could move forward if he were required to <br />install a sprinkler system and provide an escrow guaranteeing the installation of the blacktop and <br />curbing. Mr. Vevea then requested that his request for site plan approval be tabled and Council d/d <br />SO. <br /> <br />In October of 1991, Mr. Vevea approached City Staff with a proposal for a way to meet the City's <br />standards and proceed with his expansion. Mr. Vevea is proposing to construct his addition with <br />fire wails and thereby eliminate the need for an automatic sprinkler system. Mr. Vevea has <br />suggested that his certificate of occupancy for the sumcture be used in place of the financial <br />guarantee for curbing and blacktop improvements. Mr. Vevea is proposing that he receive a <br />temporary certificate of occupancy upon installation of the concrete curbing and no final certificate <br />of occupancy will be issued until the bituminous surface has been installed. The deadline for <br />installing the improvements is July 1, 1992. Therefore, if the bituminous surfacing is not installed <br />by that date, Mr. Vevea will lose his right to occupy the facility until those improvements are <br />completed. <br /> <br />8;l. <br /> <br /> <br />
