Observations:

To the best of my knowledge, the City has not waived the required financial guarantees on
previous site plans and to do so would be setting a precedent. In addition, using the occupancy of
the structure as a leverage to site improvements would be very difficult to enforce. And if Mr.
Vevea did fail to install the required improvements and the City were successful in vacating the
structure, we would be left with a vacant building having no certificate of occupancy and no funds
escrowed to complete the improvements so that a certificate of occupancy could be issued.

The following items are enclosed for your information:

a)
b)
c)
d)
e)
f)
g)

Site location map
Site plan
Memo from Economic Development Commission dated October 10, 1990
City Engineer's Review Letter dated October 11, t990.
Planning and Zoning Commission meeting minutes dated October 16, 1990.
City Council meeting minutes dated October 23, 1990
Proposed site plan development permit

Recommendation:

City Staff recommends approval of the site plan contingent upon Mr. Vevea providing a financial
guarantee for the required site improvements.

Council Action:

Motion to:
Approve/deny Mr. Bernie Vevea's site plan for the expansion of Ve-Ve, Inc.

Review Checklist:

CC:

10/22/91

City Administrator
City Engineer
City Attorney
Zoning Administrator

I
i
I
i
I

I
I
!
