CASE <br /> <br />AMENDMENT OF CHAPTER 7 OF THE CITY CODE <br />REGARDING CHARITABLE GAMBLING <br /> By: Ryan R. Schroeder, City Administrator <br /> <br />Background: <br /> <br />At the July 23, 1991 Council meeting an ordinance was introduced amending City Code Sections <br />7.61 and 7.62 regarding charitable gambling and bingo. It was directed, at that meeting, that the <br />£~rst reading of the ordinance occur and that it be passed to the Budget Comminee for further <br />review. <br /> <br />Staff also contacted, by letter, the three gaming organizations operating in the City of Ramsey. It <br />was requested in that correspondence that they respond to us by the end of October with any <br />comments. We did receive a visit from the Cystic Fibrosis organization but have not talked with <br />the Anoka Area Hockey Association or the Ramsey Lions in response to our correspondence. <br /> <br />Since the July 23, 1991 meeting we have become aware that there have been a couple of State <br />Statute changes which impact' our ordinance. The first is the maximum rental fee ~that can be <br />charged the gaming organization by the lessor. The second is the investigation fee that the City of <br />Ramsey can charge is limited to $100.130 as opposed to our existing $400.00 fee. Therefore, what <br />is in front of you is a new ordinance amendment which deals with both of these issues. With <br />regard to the first issue, we would like to suggest that rather than setting a defined maximum rental <br />fee, the organizations involved be required to operate as defined by State Statute. Regarding the <br />second issue of the investigation fee, we are suggesting that it just be stated that there is an <br />investigation fee and that it will be set by resolution from time to time by the Council. In addition <br />to these, in the first reading we had defined that the gaming profits must be spent within the <br />Ramsey trade area. We would also like to amend these two para~aphs to direct that, in addition, <br />ten percent of the gaming profits must be expensed for lawful purpose as specifically defined by <br />the City of Ramsey. <br /> <br />Recommendation: <br /> <br />In that these ordinances have changed significantly from the £~rst reading, it is suggested that <br />Council make a motion to reintroduce an ordinance a amending Section 7.61 entitled "Charitable <br />Gambling" and Section 7.62 entitled "Bingo" of the City Code. It is also suggested that since this <br />ordinance has alreadv received significant review and an oppormni~, by the organizations impacted <br />to comment on it that the second reading of the ordinance appear on a December Council meeting <br />without further review by the Budget Committee. <br /> <br />Council Action: <br /> <br />Motion to reintroduce Ordinance g'91-~ mending Section 7.61 entitled "Charitable Gambling" <br />and Section 7.62 entitled "Bingo" of the Ram~ey City Code. <br /> <br />Review Checklist: <br /> <br />City Administrator <br />City Attorney <br />Police Chief <br />Finance Officer <br /> <br />CC: 11/12/91 <br /> <br /> <br />
