ORDINANCE g91-XX <br /> <br />CITY OF RAMSEY <br />ANOKA COUNTY <br />STATE OF MINNESOTA <br /> <br />AMENDMENT TO CHAPTER 7 WHICH IS KNOWN AS THE LICENSING AND <br />PERMITS CHAPTER OF THE CITY CODE <br /> <br />AN ORDINANCE AMENDING CHAPTER 7, SECTION 7.61 OF THE CITY <br />CODE OF RAMSEY, MINNESOTA <br /> <br />The City of Ramsey Ordains: <br /> <br />SECTION 1. AUTHORITY <br /> <br />This Ordinance is adopted pursuant to and under the authority of the Home Rule Charter of the <br />City of Ramsey. <br /> <br />SECTION 2. <br /> <br />AMENDMENT <br /> <br />A. 7.61 Charitable Gambling <br /> <br />The following section shall be added to Section 7.61. <br /> <br />7,61.08 Use of Charitable Gambling Profits. Pursuant to Minnesota Statute <br />Section 3.49.213, the yearly net profits of any licensed charitable gambling organization <br />shall be spent in the trade area of the City of Ramsey or on items or activities that will <br />directly benefit the citizens of the City of Ramsey. For purposes of this paragraph, the <br />term trade area shall mean all of that area described as the Cities of Ramsey, Elk River, <br />Dayton, Anoka, Andover and the Township of Bums. The applicant shall be required to <br />spend ten percent of its net profits derived from lawful gambling within the City of Ramsey <br />upon a lawful purpose specifically designated by the City Council. <br /> <br />The following paragraphs shall be amended to read: <br /> <br />7.61.04 (f) A lease agreement between a non-profit organization and a gambling <br />location owner or operator shall not provide for rental payments based on a percentage of <br />receipts or profits from lawful gambling. There shall be no other compensation paid to the <br />gambling location owner or operator, directly or indirectly, other than the rental fee <br />provided in the lease a~eement. The maximum rental feel shall be as defined by State <br />Statute. <br /> <br />7.71.07 Fee. Upon apphcation, the City will charge all new apphcants an <br />investigation fee to cover costs incurred investigating the apphcation. Any unused pomon <br />of this fee will be refunded to the apphcant. This fee does not apply to apphcations for <br />renewal of hcenses. This fee may change from time to rime as determined by resolution of <br />the City. Council. <br /> <br /> <br />
