CASE <br /> <br /> VoH. <br /> <br />Background: <br /> <br />APPLICATION FOR LIQUOR LICENSE BY <br />ENTERPRISES, INC.; CASE OF JOEL LALLEY <br /> By: Mike Auspos, Police Chief <br /> <br />Joel Lalley has applied for a liquor license at Jimmy B's American Cafe and Lounge located <br />at 6937 Highway #10 N.W. According to his application, the name will remain Jimmy B's <br />American Cafe and Lounge and Mr. Lalley will be leasing the building and equipment. His <br />application is for on-sale intoxicating liquor with Sunday sales. At the present time the <br />premises are licensed for on-sale intoxicating liquor and Sunday sales and has a restaurant <br />facility serving food, thereby qualifying for the Sunday sales. <br /> <br />Findings: <br /> <br />As of the meeting date of November 12, 1991 I have received from Mr. Lalley the <br />following: <br /> <br />a) <br />b) <br /> <br />c) <br />d) <br /> <br />Copy of the Certificate of Incorporation for V.H. Enterprises, Inc. <br />Financial information regarding the lease agreements and method of <br />financing <br />Statement from Anoka County that personal property taxes are paid current <br />Certificate of insurance from Swett and Cmwford showing V.H. <br />Enterprises, Inc. dba Jimmy B's American Cafe and Lounge having a <br />policy meeting minimum State standards for liquor liability <br /> <br />I have run a criminal history check on Mr. Laltey and them is no showing of a conviction <br />of liquor laws which would preclude his having a liquor license. We previously discussed <br />a violation which in his original application would have made him ineligible: however, the <br />court which has jurisdiction in that matter issued a Vacation of Conviction Order. It is the <br />City Attorney's opinion that this makes Mr. Lalley eligible now for the license. <br /> <br />Mr. Lalley's application indicates that he and James Brown, current owner of Jimmy B's, <br />have an agreement between themselves to arrange payment of the license fee. Since the <br />City received the full amount of the fee for the current license as of July 1, 1991 and this <br />was good until June 30, 1992. it would appear that license fees for this ~ansfer of license <br />are current and will be until the next renewal date. <br /> <br />Mr. Laltey originally paid an investigation fee of $250. A criminal history check on <br />Marsha Lalley, a shareholder of V.H. Enterprises, Inc., is clear of any violations. <br /> <br />Recommendation: <br /> <br />Staff recommends that Council approve the transfer of the on-sale intoxicating liquor <br />license and Sunday sales license from S.J.S., Inc. to V.I-I.
