Councilmember introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #91-12- <br /> <br />RESOLUTION AUTHORIZING VACATION OF STREET RIGHT-OF-WAYS <br />ACROSS OUTLOTS C AND D OF NORTHFORK P.U.D. <br /> <br /> WHEREAS, certain street right-of-way easements have been acquired by the City during <br />the development of Northfork P.U.D.; and <br /> <br /> WHEREAS, certain street easements are no longer necessary for use by the City and <br />public; and <br /> <br /> WHEREAS, the original need by the City for said easements has been replaced by other <br />easements which adequately address the City's requirements; and <br /> <br /> WHEREAS, the developer of Northfork P.U.D. has requested the City vacate said <br />easements; and <br /> <br /> WHEREAS, M.S.A. 412.851 entitled Vacation of Streets permits the City Council to <br />vacate public grounds and public ways; and <br /> <br /> WHEREAS, on December 3, 1991, the Planning and Zoning Commission held a public <br />hearing regarding the issue of vacating said easements in Northfork P.U.D., which public hearing <br />was preceded by two weeks public notice in the Anoka County Union and posted notice, and at <br />which public hearing all members of the public present were given the opportunity to be heard; and <br /> <br /> WHEREAS, after consideration of alt relevant factors, the City Council finds that it is in <br />the best interest of the public to vacate said street right-of-way easements. <br /> <br />NOW TItEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1 ) That the street right-of-way easement legally described as follows is hereby vacated to wit: <br /> <br />A 66.00 foot easement for roadway purposes over, under and across that part of <br />Outlot C, NORTHFORK embraced within the Northeast Quarter of Section 18, <br />Township 32, Range 25 and that part of Outlot C, NORTHFORK embraced within <br />the East Half of the Northwest Quarter of Section 17, Township 32, Range 25, said <br />roadway to lead from Andrie Road at the Southwest corner Of Lot 2, Block 3, <br />NORTHFORK easterly to existing 164th Avenue in WOODLAWN ESTATES; all <br />in the City of Ramsey, County of Anoka, State of Minnesota. <br /> <br />2) That the street right-of-way easement legally described as follows is hereby vacated to wit: <br /> <br />A 66.00 foot easement for roadway purposes over, under and across Outlots C and <br />D, according to the plat of NORTHFORK on file in the Office of the Registrar of <br />Titles, Anoka County, Minnesota. The centerline of said easement is described as <br />follows: <br /> <br />Commencing at the most easterly corner of said Outlot D; thence North 89 degrees <br />12 minutes 26 seconds West, record bearing, along the southerly line of said Outlot <br />D 264.25 feet; thence North 79 degrees 59 minutes 27 seconds West along said <br />southerly line 290.76 feet to the point of beginning of the centerline to be described; <br /> <br /> <br />
