CITY OF RAMSEY <br /> ANOKA COUNTY, MINNESOTA <br />DEVELOPMENT AGREEMENT- COWLES ADDITION <br /> <br />Tills AGREEMENT, made and entered into by and between the CITY OF RAMSEY, a <br />municipal corporation of the State of Minnesota (the "CITY"), and GEORGE A. COWLES <br />and FRANCES D. COWLES, husband and wife, whose address is 19731 Rush Street, Elk <br />River. Minnesota ("the DEVELOPERS"). <br /> <br />WITNESSETH: <br /> <br /> WHEREAS, the DEVELOPERS are the fee owners of the following described property <br />situated in the CITY OF RAMSEY, County of Anoka, State of Minnesota, and legally described <br />as follows: <br /> <br />Cowles Addition, Anoka County, Minnesota, <br /> <br />the "Subject Property"; and <br /> <br /> WHEREAS, on December 17, 1991, pursuant to Resolution #91-12- , the CITY <br />approved the final plat of the Subject Property which plat is known as COWLES ADDITION <br />(the "Plat") contingent on certain requirements, including DEVELOPERS and CITY entering <br />into this contract; and <br /> <br />WHEREAS, the Plat consists of two (2) lots totalling approximately three (3) acres; <br /> <br /> WHEREAS, approval of the Final Plat is given pursuant to the City's Subdivision Code <br />Section 9.50.05 (Subd. 2) entitled "Division or Consolidation of Unplatted Lots". <br /> <br /> WHEREAS, no expenditure of CITY funds will be made until City Code escrow <br />requirements have been fulfilled by the DEVELOPERS. <br /> <br />NOW, THEREFORE, the CITY and DEVELOPERS agree as follows: <br /> <br />IMPROVEMENTS <br /> <br />Access to Lots. All lots in the Plat shall have access onto Hwy. #10 via a shared <br />driveway situated on the common property line between Lots 1 and 2. <br /> <br />Drainage and Utility Easements. Ten foot drainage and utility easements shall be <br />provided along the perimeter of each lot and shall be dedicated to the CITY as shown on <br />the Final Plat. <br /> <br />II. <br />GENERAL <br /> <br />Land Use: As of the date of this agreement, there are four(4) land uses existing on Lots l <br />and 2 of the Plat. The auto body repair business on Lot 1 and the private residence on Lot <br />2 are determined to be non-conforming. These two uses and their respective structures <br />may continue to exist but may not be enlarged or reconstructed for the same purpose if <br />destroyed to the extent of more than 50% of its fair market value, said value to be <br />determined by the City Assessor.
