CASE # EXTENSION TO THE CONDITIONAL USE PERMITS ISSUED TO WASTE MANAGEMENT OF MINNESOTA By: Ryan R. Schroeder, Cily Administrator Background: As Council is aware, on Tuesday, November 26, 1991, this issue appeared on the Council agenda and was tabled in that only three members could be at that particular meeting and given the weight of the issue, we were not comfortable with a simple maLjority dealing with it. Enclosed for your review is the agenda case from that meeting. In discussions with Waste Management, they have reported that it is certainly their intent to live within the terms of the conditional use agreement written on November 15, 1988, which would result in the landfill receiving its last load of mixed municipal solid waste on December 31, 1993. Waste Management has also reported that volumes having been received since this original contract have been significantly less than originally projected; therefore, the grades of the landfill are deficient of where they thought they would be by this point in time. As a result, they are intending to submit an application with the Pollution Control Agency for a new grading plan. They have further reported that the preparation of this plan and initial review by the PCA will take a six-month period. It is staff's position that it is in the City of Ramsey's best interest to assist Waste Management's efforts to receive PCA review of a new grading plan. It is also staff's position that were the landfill to close today, there would continue to be truck traffic in and around the landf'dl in order to complete grades. Further, whether this truck traffic is created by regrading using fill material or by landfilling mixed municipal solid waste, there would be a similar impact upon roadways and adjacent neighborhoods. Finally, it is staff's reading of past agreements and the November 1988 conditional use permit that it was the intent of the Council at that time, and of Waste Management, that this landfill would be operating for no more than a five-year period and that allowing for the continued operation of the landfill at least through the period of the PCA permit application for new grading of the landfill is simply a continuance of past agreements. You will note within the case from the earlier meeting that there are existing permits for grading and excavation, tire processing, the office structure, yard waste composting and the water treatment facility. It would be staff's desire to close out the yard waste composting facility as is currently occurring but to time that balance of other permits concurrent with that of the vertical expansion. Therefore, it is staff's recommendation that Council authorize extension of the permits mentioned above through June 30, 1992 contingent upon all terms of the various permits continuing to be met by Waste Management. i I I I Council Action: Motion to approve an extension of the conditional use permits for vertical expansion, grading and excavation of the north borrow area, tire processing and the temporary office structure through June 30, 1992 upon satisfaction of all other conditions within the original permits and demonstration of a new PCA application for the vertical expansion and grading plan change based upon reduced capacity goals.
