(f) "Participant" means a person who is an employee on or after January 1, 1992 and <br />who satisfies the participation conditions of Article II, 2.1. The employee shall be eligible to <br />participate on the first day of the month following employment with the City, subject to the entry <br />date limitations in Sections 4.4, 4.6 and 4.7. A person who has become a participant shall remain <br />a participant until all benefits due under the provisions of the Plan have been paid or otherwise <br />have been satisfied under the terms of the Plan. <br /> <br /> (g) "Plan" means the Flexible Benefit Account Plan as set forth herein and as may be <br />amended or restated from time to time. <br /> <br /> (h) "Plan Year" means the twelve month period commencing January 1 and ending <br />December 31. <br /> <br />(i) "Exempted Injury or Sickness" means any injury or sickness: <br /> <br /> (i) incurred when a Participant, spouse, or Dependent was engaged in, or <br />resulting from a Participant, spouse, or Dependent having engaged in, a criminal enterprise; <br /> <br /> (ii) resulting from an intentionally self inflicted injury of a Participant, spouse, <br />or Dependent. <br /> <br /> (j) "Injury" means an externally caused sudden hurt or damage to the body brought <br />about by an identifiable event. <br /> <br /> (k) "Sickness" means all bodily infirmities, diseases, mental illness, and other <br />disorders other than an injury. <br /> <br /> (1) "Medical Care" includes the diagnosis, cure, mitigation, treatment, or prevention of <br />sickness, injury, or defect. Expenses for Medical Care shall include, but not be limited to, any <br />payment for the purpose of affecting any structure or function of the body, for any hospital or <br />nursing charges, optometrical, ophthalmological, or auditory care, dental care, psychiatric care, <br />drugs and prescriptions (including eyeglasses, or hearing aid appliances, non-prescription drugs, <br />medical related transportation expense, medical insurance premiums, as well as all other medical <br />care as defined in Section 213(e) of the Code. <br /> <br />ARTICLE II <br /> <br />Participation Condition~ <br /> <br /> Section 2.1. Participation Conditions. As a condition to participation and <br />receipt of benefits under this Plan, the Participant agrees to: <br /> <br />(a) Furnish to the City the enrollment forms provided for in Section 2.2 below. <br /> <br />(b) Observe all rules and regulations implementing this Plan. <br /> <br /> (c) Consent to inquiries by the City with respect to any physician, hospital, or other <br />provider of medical care involved in a claim under this Plan. <br /> <br /> (d) Submit to the City all reports, bills and other information which the City may <br />reasonably require. <br /> <br />2 <br />12/11/91 <br /> <br /> <br />
