CUP, I have spoken with Merland <br />Otto and reviewed meeting minutes and files of this case. In <br />review of the reasons Mr. Rychner gave you for not paying the <br />consulting fees for review of the CUP, I would offer the following <br />comments: <br /> <br />Reasons for Mr. Otto not pointing out the requirement of the <br />performance standard that prohibits exterior storage if the <br />Industrial District property abuts a Residential District was <br />because this is a requirement of the I-1 District zoning code <br />which applied even though Mr. Rychner revised his application <br />to eliminate the recycling center from his proposed. In the <br />original discussion, this was a mute point, since Ordinance <br />90-5 prohibits the location and operation of a Solid Waste <br />Management Facility within 1000 feet of an occupied dwelling <br />as proposed by Mr. Rychner. The impacts of Ordinance 90-5 <br />were discussed with Mr. Rychner in the initial meeting between <br />City staff, Mr. Otto and Mr. Rychner. This was also detailed <br />in the original draft findings of fact. <br /> <br />Mr. Rychner's claim that Danny's Aluminum did not have to meet <br />the requirements of Ordinance No. 90-5 and his operation was <br />being singled out for selective enforcement is not true. At <br />the time the CUP for Danny's Aluminum was being amended, the <br />City was not aware that Danny's Aluminum was accepting waste <br />other than aluminum. Upon discovery of finding out that <br />Danny's Aluminum was accepting waste other than aluminum, <br />Mr. Otto asked Ms. Sylvia Frolik, Zoning Administrator, to <br />send a letter to Danny's Aluminum to stop accepting other <br />waste or require that he ask for a further CUP amendment.
