Hakanson
Anderson
Assoc..Inc.

Engineers, Surveyors &.
Landscape Architects

April 19, 1991

~..,r James Gilbertson, Mayor
City of Ramsey
15153 Nowthen Blvd. N.W.
Ramsey, MN 55303

Re:

Glen Rychner
CUP - Aluminum Recycling, Inc.

Dear Jim:

Following our meeting this morning with Sandra Ashley regarding the
Rychner Aluminum Recycling, Inc. CUP, I have spoken with Merland
Otto and reviewed meeting minutes and files of this case. In
review of the reasons Mr. Rychner gave you for not paying the
consulting fees for review of the CUP, I would offer the following
comments:

Reasons for Mr. Otto not pointing out the requirement of the
performance standard that prohibits exterior storage if the
Industrial District property abuts a Residential District was
because this is a requirement of the I-1 District zoning code
which applied even though Mr. Rychner revised his application
to eliminate the recycling center from his proposed. In the
original discussion, this was a mute point, since Ordinance
90-5 prohibits the location and operation of a Solid Waste
Management Facility within 1000 feet of an occupied dwelling
as proposed by Mr. Rychner. The impacts of Ordinance 90-5
were discussed with Mr. Rychner in the initial meeting between
City staff, Mr. Otto and Mr. Rychner. This was also detailed
in the original draft findings of fact.

Mr. Rychner's claim that Danny's Aluminum did not have to meet
the requirements of Ordinance No. 90-5 and his operation was
being singled out for selective enforcement is not true. At
the time the CUP for Danny's Aluminum was being amended, the
City was not aware that Danny's Aluminum was accepting waste
other than aluminum. Upon discovery of finding out that
Danny's Aluminum was accepting waste other than aluminum,
Mr. Otto asked Ms. Sylvia Frolik, Zoning Administrator, to
send a letter to Danny's Aluminum to stop accepting other
waste or require that he ask for a further CUP amendment. Had
Mr. Otto known that Danny's Aluminum planned on accepting
solid waste other than aluminum at the time the CUP was
amended, they would have had to comply with the requirements
of Ordinance 90-5.

2'2'2 Monroe Street
Anoka, Minnesota 55303

61 2/427-5860
Fax 612/427-3401
