constitutional or common law right to privacy in most of the data contained in their driver's license <br />records. That is consistent with the previous decisions. <br />What's new? These orders contain very helpful language regarding the level of detail that needs <br />to be included in the factual allegations in order for the complaint to be deemed sufficient to move <br />forward. Simply put, baldly alleging that the defendants had no legitimate purpose for accessing <br />a driver's license record is not enough. The Bass decision cites an older Supreme Court case for <br />the proposition that "in the absence of clear evidence to the contrary, courts presume that [public <br />officers] have properly discharged their official duties." U.S. v. Chem. Found., Inc., 272 U.S. 1, <br />14 -15 (1926). This supports the holding that a plaintiff must plead sufficient facts to make it <br />plausible that a defendant did not have a legitimate purpose for accessing their records. Merely <br />saying "I was looked up hundreds of times by fifty different law enforcement agencies" is not <br />enough. They need to assert facts showing improper access of those records. This helps to further <br />narrow the scope of these claims and to put more of a burden on the plaintiffs. <br />Engineering Department Updates. The Anoka Conservation District, in cooperation with the <br />Lower Rum River Watershed Management Organization, developed and mailed informational <br />brochures last week to owners of property within the Lower Rum River Watershed District that <br />may contain wetlands. The brochure also contains contact information in case a property owner <br />has questions about wetlands in general, or if they suspect they might have a wetland on their <br />property and would like additional information. The open house for the Highway 10 access study held <br />by MnDOT on February 26, was a great success. Over 100 property owners and business people <br />attended and voiced their opinions on the road design. Audience participation was good and a <br />number of suggestions were make on how to improve portions of the project. These comments <br />will be incorporated into the future design options. <br />The Cold Winter Has Taken Its Toll - on most everything; including the numbers of skaters at <br />the two primary rink locations in Ramsey. The numbers of users at the warming houses are <br />counted by rink attendants each shift — and remain similar year -to -year in two ways. There are <br />more patrons annually at Ramsey Elementary School than Central Park due to greater population <br />densities, and the pedestrian connections for young people who do not drive. <br />Additionally, the total numbers (both facilities) usually is around 6,500 and 7,000+ persons. Last <br />year's total was 5,953. As of last weekend, the total for this winter (2013 -14) was 4,853 (7% more <br />at the school than Central). "Weather permitting" the rinks and warming houses will remain open <br />until 8:00 p.m. Sunday the 9 of March. Even if the `weather [would] permit', the rinks will be <br />closed for the season on Monday the 10 Think Spring... <br />Snow and Ice are Still Dominating. Last Friday we dealt with the biggest storm of the season so <br />far, receiving 11" of snow, combined with high winds and subzero temperatures. City -wide <br />plowing was completed in 12 -1/2 hours, with another city -wide plowing event on Saturday for <br />cleanup. The plowing event was prolonged by deep snow, an icy under layer on the roadway, <br />severe drifting in areas, and numerous cars stuck or abandoned in the roadway. We are treating <br />
