Commissioner Bauer introduced the following resolution and moved for its adoption: <br />RESOLUTION #14 -02 -029 <br />1111111111111110 <br />Record ID 2676364 <br />RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE TO LOT WIDTH, LOT <br />AREA, THE SETBACK FROM THE ORDINARY HIGH WATER MARK AND <br />MUNICIPAL SERVICES TO FACILITATE CONSTRUCTION OF A SINGLE FAMILY <br />HOME. <br />WHEREAS, Kevin Fluegel (Permittee) has properly applied for a variance to Section 117- <br />148 (Critical River Overlay District Development Standards) and 117 -111 (R -1 Residential <br />District) of the Ramsey City Code with regard to lot area, lot width, the setback from the ordinary <br />high water mark and municipal services to construct a single family home on the property generally <br />known as 14740 Bowers Drive NW and legally described as follows: <br />Lot 6 Bowers Mississippi Acres, 'subject to easement of record, Anoka County, <br />Minnesota <br />(Subject Property). <br />2078523.005 <br />AND WHEREAS, the Planning Commission conducted a public hearing on February 6, <br />2014, pursuant to Section 117 -53 of the Ramsey City Code, and adopted findings of fact relating <br />to the request for a variance. <br />NOW THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1. That based on Findings of Fact #0921, a variance to lot area, lot width, setback from the <br />ordinary high water mark of the Mississippi River, and municipal services to facilitate the <br />construction of a single family home on the Subject Property is hereby granted. <br />2. That all portions of the proposed single family home, including any attached deck, constructed <br />on the Subject Property shall be setback at least 136 feet from the Ordinary High Water <br />(OHW) level of the Mississippi River. <br />3. That the Permittee shall be responsible for all costs incurred in administering and enforcing <br />this variance. <br />4. That the Permittee shall obtain all necessary permits prior to commencing any earth work on <br />the Subject Property. <br />5. That the Permittee may utilize a private well and an individual subsurface sewage treatment <br />system (SSTS) and the construction of both shall be in compliance with all applicable local <br />and state regulations. <br />
