Commissioner Bauer introduced the following resolution and moved for its adoption: <br />RESOLUTION #14 -02 -028 <br />RESOLUTION ADOPTING FINDINGS OF FACT #0921 RELATING TO A REQUEST <br />FROM KEVIN FLUEGEL FOR A VARIANCE TO LOT AREA, LOT WIDTH, THE <br />SETBACK FROM THE ORDINARY HIGH WATER LEVEL OF THE MISSISSIPPI <br />RIVER AND MUNICIPAL SERVICES TO ALLOW CONSTRUCTION OF A SINGLE <br />FAMILY HOME. <br />WHEREAS, Kevin Fluegel, hereinafter referred to as "Applicant," has properly applied <br />for a variance from Section 117 -148 (Critical River Overlay District Development Standards) and <br />117 -111 (R -1 Residential District) of the Ramsey City Code with regard to lot area, lot width, the <br />setback from the ordinary high water level and use of municipal services, to construct a single <br />family home on the property generally known as 14740 Bowers Drive NW and legally described <br />as follows: <br />Lot 6 Bowers Mississippi Acres, subject to easement of record, Anoka County, <br />Minnesota <br />(the "Subject Property "). <br />NOW THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1. That the Applicant appeared before the Planning Commission for a public hearing pursuant <br />to Section 117 -53 (Variances) of the Ramsey City Code on February 6, 2013, and that said <br />public hearing was properly advertised, and that the minutes of said public hearing are hereby <br />incorporated as a part of these findings by reference. <br />2. That the Subject Property is zoned R -1 Residential (MUSA) and is approximately 0.62 acres <br />in size. <br />3. That the Subject Property is surrounded by properties also zoned R -1 Residential (MUSA). <br />4. That the Subject Property is located within the Mississippi River Corridor Critical Area and <br />the Rural Service Area as defined in MN Statutes. <br />5. That Section 117 -148 (Critical River Overlay District Development Standards) of City Code <br />establishes a structure setback of 200 feet from the Ordinary High Water (OHW) level of the <br />Mississippi River or thirty-five (35) feet from the bluff line, whichever is greater, minimum <br />lot area of two and a half (2.5) acres, and minimum lot width of 200 feet. <br />6. That Section 117 -111 (Residential District) states that all lots within the 2020 Metropolitan <br />Urban Service Area (MUSA) boundary shall be serviced by sanitary sewer and municipal <br />water. <br />
