7. That the Subject Property was platted in 1948 as part of the Bowers Mississippi Acres plat <br />and is considered lawful non - conforming with regard to lot area and lot width. <br />8. That in August of 2004, the Ramsey Board of Adjustment approved Resolution #04 -08 -200, <br />which granted a variance to the structure setback from the OHW level for the construction <br />of a new dwelling unit on Lots 5 & 6, Bowers Mississippi Acres. <br />9. That item #5 of Resolution #04 -08 -200 granted a reduced river setback of 138 feet from the <br />OHW level for the new dwelling units. <br />10. That a principal structure was constructed on Lot 5, Bowers Mississippi Acres in 2006 in <br />conformance with Resolution #04 -08 -200. <br />11. That no principal structure was constructed on Lot 6, Bowers Mississippi Acres and thus, the <br />2004 approved variance for the Subject Property became null and void. <br />12. That the Applicant is proposing to construct a principal structure with an attached deck on <br />the Subject Property that will be 136 feet from the OHW level of the Mississippi River. <br />13. That the property to the north is occupied and has a structure setback from the OHW level <br />of approximately 150 feet to the principal building and approximately 135 feet to the open <br />deck. <br />14. That the property to the south is occupied and has a structure setback from the OHW level <br />of approximately 185 feet to the principal building and 155 feet to the open deck.. <br />15. That the proposed construction of a single family home on the Subject Property appears to <br />conform to the existing development pattern established on the adjacent lots. <br />16. That a tree inventory shall be submitted by the Applicant to the City prior to issuance of a <br />building permit as required by City Code Section 117 -146 (d) (2) b. 9. <br />17. That a Certificate of Survey shall be completed and submitted with the building permit <br />application indicating the minimum distance from the OHW level to the nearest portion of <br />the structure, including an attached deck. <br />18. That John & Kristin Fluegel are the fee title owners of the Subject Property. <br />19. That on January 23, 2014, the City notified the Minnesota Department of Natural Resources <br />(DNR) of the request for a variance to lot area, lot width, setback from the OHW, and <br />municipal services. <br />20. That on January 24, 2014, the City received a response from the DNR stating that they would <br />not be able to review and/or provide comment on the request prior to the public hearing and <br />requested that the City send copies of the Findings of Fact and final action for their records. <br />RESOLUTION #14 -02 -028 <br />Page 2 of 4 <br />
