Police Chief Way commented that Mr. Wellman already had liability insurance in place and <br />would have to with the indoor range as well. He was not opposed to have a proof of insurance <br />condition written into the conditional use permit; however, this was already covered by State <br />Statute. <br />Chair Levine did not feel this was necessary as it was covered by State Statute. <br />Commissioner Brauer asked if a certified instructor would be at the indoor range at all times. <br />Police Chief Way stated this could be required to ensure the range was safe, however, in the end <br />this would be determined by Mr. Wellman. <br />Commissioner Field addressed the construction standards stating Minnesota Building and Fire <br />Codes have standards in place regarding the construction, ventilation and design for indoor <br />ranges. These building standards would address the construction of the range. <br />Commissioner Bauer was pleased that the City had received a large amount of support for the <br />proposed indoor shooting range. However, he had concern with the broader range of indoor <br />recreation in the B-1 zoning district. <br />Motion by Commissioner Bauer, seconded by Co r iissioner anScoy, to recommend that City <br />Council adopt Ordinance #14-01 amending Section 117-114 (B-1 General Business) to include <br />Indoor Commercial Recreation as a Conditional Use in an Overlay District and creating Section <br />117-363 establishing performance standards for Indoor Shooting Ranges. <br />Further discussion <br />Commissioner Bauer indicated the proposed use fit well into this retail node however he did not <br />see how other indoor commercial recreation would fit in to other B-1 General Business sites <br />throughout the City. He stated an overlay district would allow for the property at 167th Avenue <br />and Highway 47 to be an exception. <br />Commissioner VanScoy agreed that overlay district would be a good fit for the commercial node <br />at 167th Avenue. <br />Commercial Brauer questioned if the Commission should consider rezoning this property to B-2. <br />Development Services Manager Gladhill stated this would add additional uses that have not been <br />considered for this retail node. He reported the public hearing process would need to be re - <br />conducted if this were the route the Commission supported. <br />Commissioner Brauer supported the overlay district for this request. <br />Planning Commission/January 9, 2014 <br />Page 6 of 12 <br />
