COUNCIL BUSINESS <br />7.01: Consider Adoption of Ordinance #14 -01 Amending City Code Section 117 -114 (B -1 <br />General Business District) to Identify Indoor Commercial Recreation as a <br />Conditional Use in a Geographically Defined Area within the B -1 General Business <br />District and to Create City Code Section 117 -363 Establishing Performance <br />Standards for Indoor Shooting Ranges; Case of Total Defense, Inc. <br />Development Services Manager Gladhill stated this ordinance amendment was considered on <br />January 28, 2014, and the Council approved introduction for First Reading. At that time, the <br />Council also gave contingent approval for a conditional use to Total Defense to operate an <br />indoor shooting range at 6001 167 Avenue NW. He described the considerations before the <br />Council tonight to consider an amendment to City Code Section 117 -114 (B -1 General Business <br />District) to identify indoor commercial recreation as a Conditional Use in a geographically <br />defined area within the B -1 General Business District and establishing performance standards for <br />indoor shooting ranges. Development Services Manager Gladhill stated the Council is not asked <br />to review the conditional use of Total Defense that received conditional approval but the <br />applicant has indicated they are open to the concept of adding conditions of approval. He <br />advised that if the ordinance is changed tonight, staff would recommend it be reintroduced for <br />First Reading. If not adopted, the approval granted to Total Defense would become null and <br />void. Development Services Manager Gladhill presented a framework of the Council's <br />legislative discretion. He noted that based on public input, a webpage was created to receive <br />additional feedback. Development Services Manager Gladhill stated the consideration tonight is <br />ordinance specific. He presented a list of recommended restrictions related to indoor shooting <br />ranges, noting the considerable vetting of staff on issues relating to safety for this use and <br />extensive opportunity for citizen engagement. Development Services Manager Gladhill stated <br />staff also reached out to all retail tenants within the 167 Avenue commercial node to gain their <br />input and held an open house prior to the official public hearing to provide additional <br />opportunity for comment. He indicated there was very little public comment at that point, <br />mostly in support, and it was indicated at that time that there was a child care business in this <br />area. Development Services Manager Gladhill reviewed the Planning Commission's discussion <br />and recommendation that Section 117 -363 be revised to include a provision regarding the storage <br />of firearms during overnight hours. <br />Development Services Manager Gladhill stated the owner of the Little Me Child Care contacted <br />staff to express concern with the proposed indoor shooting range. Due to that concern and e- <br />mails received expressing a similar concern, staff scheduled another public meeting last night to <br />garner more information on concerns of the clients of Little Me Child Care and its owner.
