stated a lot of concern was expressed at that meeting by the owner of Little Me Child Care and <br />parents using that business and staff will enter those comments into the record. Development <br />Services Manager Gladhill presented changes staff had incorporated into paragraph (j) of the <br />proposed amendment stating that any weapons stored overnight on the premises shall be properly <br />secured, per the direction of the Police Chief, and the provision of which shall be negotiated <br />through the Conditional Use Permit. <br />Development Services Manager Gladhill reviewed the third -party sources of information staff <br />had used to vet this request. He presented options for the Council's consideration: to adopt <br />Ordinance #14-01 as introduced; to amend Ordinance #14-01 to add safety standards and <br />reintroduce at a future meeting; or, to not adopt Ordinance #14 -01, which would also void the <br />contingent approval granted to Total Defense. Development Services Manager Gladhill advised <br />of the counter - petition process should the Ordinance be adopted tonight and published in the <br />Anoka Union. He explained that public comment does not create negative liability in tonight's <br />legislative decision. The owner of Little Me Child Care may have the ability to bring District <br />Court review due to the proximity of its location; however, public comment provided by Little <br />Me Child Care this evening likely would not be utilized to reverse the City's decision, as proper <br />notification of public haring was provided and comments were not submitted as part of the <br />public haring, according to case law. Development Services Manager Gladhill stated the <br />Planning Commission was apprised of the new information/concerns that had been received and <br />the Planning Commission made no change in its recommendation. <br />Mayor Strommen indicated that 24 people have requested the opportunity to speak and while the <br />public hearing has already been held, she would use her discretion to open the floor to the public. <br />She asked that comments be limited to two to three minutes with a total of one hour allowed for <br />comment. Mayor Strommen indicated she will first hear from Ramsey's residents and business <br />owners and asked that the comments focus on the zoning issue. She also reminded the audience <br />to use proper public decorum. <br />Patrick Farley, attorney representing Little Me Child Care, stated there is nothing new that he <br />can comment on but his client is prepared to file for injunction if she feels that is the proper <br />remedy for her He deferred his comments to Ms. Brick. <br />Amber Brick, co -owner of Little Me Child Care, stated they are in full support of the Second <br />Amendment. Her concern relates to her clients, children hearing gunshots, and parents and <br />children seeing guns being carried to and from this facility. She described the affordable and <br />needed service she provides and submitted ten letters representing 14 children or 30% of her <br />business, that will leave her care if this use is approved. Ms. Brick described the investment she <br />and her family made to start this business. She stated they are in the first year of a negotiated <br />lease and if she loses 30% of her customers, they will lose $100,000. She described the negative <br />impact this will create in her business and for her eight employees. <br />Carrie Budnick, 5672 157 Avenue NW, stated her two children are at Little Me Child Care as it <br />is affordable and while she is a gun supporter, she does not support this location next to a <br />daycare facility and if approved, she will remove her children from this daycare facility. <br />City Council / February 11, 2014 <br />Page 5 of 12 <br />
