coverage. The short-term disability insurance just approve~ wou]~
not apply in this case. The recommendation is that whatever the
package Is for the short-term disability, that the benefit De
determined and given to Mr. Guimont Dy the City, in effect,
retroactively.

Ms. McAIoney gave the background information regarding the method
of caculatlng benefits by Workers' Compensation for volunteer
flrefighters, noting Mr. Gulmont receives $274.6? per week. Mr.
Guimont is requesting $2,360 per month In addition to Workers'
Compensation. Since short-term disability insurance has Just been
approved Dy the Council, a proposal would be to pay Mr. Guimont
an additional $800 per month since November 4, which ts 15 days
after the injury was Incurred, until the end of the year. That
amount is equivalent to the proposed short-term disability
insurance program. At that time Mr. Guimont wi]] also have to
submit a copy of his 1989 Federal Income Tax form ann Schedule C.

Jay GulmQnt - explained he was never to]d about the coverage in
case of injury; he assumed he was covered and his wages would be
met. He stated he cannot support a family of five on $274 a week.
He is self-employed and has lost a lot of money as a result of this
injury. He said he would provide the necessary information after
the end of the year, though he has already supplied year-to-date
materla]s. Mr. Guimont stated the very limited coverage was a
surprise to everyone on the Department. He may have given
consideration to not volunteering or made other arrangements if he
had known the minima] coverage they had. He said he is just asking
for his wages to be met. Ms. McAloney stated the City was not
obligated to provide any more coverage than ]t did, and many other
clties have only Workers' Compensation.

~ruce Hoeke, Flrefighter - stated the first Firefighters weren't
told anything about coverage. He explained the current procedure
for accepting Dew fireflghters, but they receive nothing in writing
about their coverage for injuries.

Mr. Ho×ter - stated the FJrefighters were under the assumption
that their compensation under Workers' Comp wou]~ cover their'
wages; and he thought they were covered because they couldn't start
their training until the City told them they were insured. That is
why they are surprised that they really weren't covered.

A lengthy discussion ensued with several Firefighters and Staff'
regarding the information told to the Firefighters when they
volunteered: on how benefits are ~etermined unGer WorKers'
Compensation based on a Firefighter's imputed wage, not the actual
outside wage of the in.)ured person: on the City's coverage of
general liability insurance and Workers' Compensation insurance,
plus the short-term disability insurance approved this evening
which will De effective sometime early next year; and on Mr.
Guimont's request for compensation.

CITY COUNCIL/DECEMBER ii, 1990
Page 10 of i?
