MEMORANDUM OF UNDERSTANDING <br />BETWEEN THE CITY OF RAMSEY AND AFSCME <br />ARTICLE 21 UNIFORMS <br />This Memorandum of Understanding is made between the City of Ramsey ("City") and <br />AFSCME ("Union."); and <br />WHEREAS, the City and the Union are parties to a 2013-2014 collective bargaining agreement; <br />and <br />WHEREAS, the collective bargaining agreement, Section 21.5 states , in part, " Public Works <br />Maintenance Workers, Engineering Technicians, Building Maintenance Workers and Building <br />Inspectors may submit an original store receipt to the EMPLOYER for a one time <br />reimbursement per year..."; <br />WHEREAS, the requirements of performing their duties make it necessary for Union members <br />to obtain clothing that is considered taxable under state and federal law, if provided by the City; <br />THEREFORE, the parties met, negotiated and agreed upon the following: <br />1. For 2014, the City will provide a monetary uniform stipend to Public Works Maintenance <br />Workers, Engineering Technicians, Building Maintenance Workers and Building <br />Inspectors. <br />2. The annual uniform stipend will be paid to these EMPLOYEES in one payment through <br />their regular biweekly payroll disbursement. This stipend will be included in the <br />EMPLOYEES' taxable earnings and applicable taxes will be withheld according to <br />Internal Revenue Service. <br />3. The uniform allowance, including boots, for 2014 will be $525.00; the same amount as <br />stated in the 2013-2014 labor agreement, and will be paid on the second payroll in <br />March. <br />4. Members utilizing the City's uniform service, and therefore only requiring the purchase <br />of boots, will be paid $150.00 for boots, the same amount as stated in the 2013-2014 <br />labor agreement, and will be paid on the second payroll in March. <br />WHEREAS; due to the changes listed above, Section 21.3 of the 2013-2014 labor agreement, <br />shall be null and void: "All uniform items provided by the EMPLOYER shall remain the <br />property of the EMPLOYER and as each item is either discarded or replaced, the discarded or <br />replaced items shall be returned to the EMPLOYER." In the event any such items are lost or <br />damaged through the negligence of the EMPLOYEE possessing said property, (reasonable wear <br />and depreciation expected), such EMPLOYEE shall be financially responsible for the <br />replacement of said negligently lost or destroyed item. <br />
