§ 5.12 Condilions ofp~ In any area the existence of an5' structure or part of an5' structure which because of fire, wind, or other natural disaster, or physical deterioration is no longer habitable as a dwelling, nor useful for any other purpose for which it may have been intended. In any area zoned for residentiaJ purposes, the existence of any vacant dwelling, garage or other outbuilding,unless such buildings are kept securely locked, windows kept glazed or neat]>, boarded up and otherwise protected to prevent entrance thereto by vandals. 5.12.02 Powers of office, V, rhenever in the judgment of the health authority, zoning officer, or chief of police (or such other officers as may be determined by the administrator/clerk), he finds upon investigation that a blight condition is being maintained or exists within the City of Ramsey and ~ithin the respective fields of supervision as hereinbefore set forth, they shall issue a written notice to the owner or occupant and require him to terminate and abate said blight condition or to remove such conditions or remedy such defects. Service of said notice shall be in person or by mail. If the premises are not occupied and the address of the owner is unknown, service on the owner may be had by posting a cop>' of the notice on the premises, tf said blight condition is not abated ~-ithin ten days of the date of issuance of said notice, the city official issuing said notice shall issue a code violation to the notified owner or occupant. 5.12.03 Abatement of nuisances by council If, after such sero-ice of notice, the party or part]es fail to abate the blight condition or make the necessaw repairs, alterations or changes in accordance w~th the direction of the count{l, said council ma)' cause such blight condition to be abated at the expense of the city and recover such expenditure, plus an additional 25% of such ez-penc]Jture, either by civil action against the person or persons served; or if such ser~dce has been had upon the owner or occupant, by ordering the adm/nistrator/c]erk to extend such sum, plus £5% thereof as a special tax against the property upon which the blight condition e~dsted and to ceftin, the s~rne to the count), auditor for collection in the manner as taxes and special assessments are certified and collected. 5.12.04 PenalW. Any person violat/ng any provision of this section is guilty of a misdemeanor and upon conviction shall be punished by a fine of not more than $500.00 or imprisonment for not more than 90 days or both.
