12. Payment for Stage II Improvements. The CITY will install in the Plat the Stage II <br /> Improvements. The DEVELOPER shall also deposit an amount that is determined by the <br /> CITY to be adequate to aid in the operation and maintenance of street lights in locations <br /> within the Plat determined by the City Engineer and installed by Connexus for the first three <br /> (3) years after final plat approval. The CITY will bill residents in the Plat at least quarterly <br /> for street light maintenance and operation costs; billing will be initiated at the time a <br /> residence connects to municipal water and sanitary sewer. The DEVELOPER will pay to <br /> the CITY an amount equal to 100% of the City Engineer's estimated construction cost of the <br /> items prior to recording of the final Plat. The City Engineer's estimated cost of construction <br /> is: <br /> <br />Street Striping (1000 If. @ $0.50/10 <br />Traffic signing ( 3 ~ $200 each) <br />Street lights (1 ~ $1,700 each) <br />Street light maintenance & operation for 3 yrs (1 x $270) <br />Sealcoating (2650 sq. yds. ~ 0.90/sq. yd.) <br />Street sweeping <br /> TOTAL <br /> <br />$50O.O0 <br />$600.00 <br />$1700.00 <br />$270.0O <br />$2400.00 <br />$5OO.OO <br /> <br />$5,970.00 <br /> <br />13. Hard Surfaced Driveways. Hard surfaced (bituminous or concrete) driveways are a <br /> requirement for each lot in the Plat. Said improvement shall be installed by the building <br /> permit applicant or the homeowner at the time the Certificate of Occupancy is issued or as <br /> soon thereafter as possible, weather permitting. In the event this improvement is not timely <br /> installed on a lot, the DEVELOPER and/or the DEVELOPER'S assign(s), agree that the <br /> CITY may install said improvement on the lot and specially assess the cost therefore against <br /> the lot. The DEVELOPER hereby waives all tights to a public heating and other statutory <br /> rights or City Charter rights granted a property owner relating to special assessments, <br /> including the right to appeal the special assessment for installation of the hard surfaced <br /> driveway. In addition, the DEVELOPER grants the CITY a license to enter on each lot of <br /> the Plat in order to install the improvement described in this paragraph if the same has not <br /> been previously constructed. <br /> <br />14. Street Cleaning. After the street surfacing is installed, the DEVELOPER shall clear any <br /> soil, earth, or debris from the streets within the Plat resulting from any construction within <br /> the Plat by the DEVELOPER or its successors and assigns. From time to time, the CITY <br /> may remove accumulations of soil, earth and debris from the streets resulting from the <br /> construction of the Plat. It shall be the DEVELOPER'S responsibility to pay the costs <br /> associated with this necessary street cleaning.
