The Planning Commission held a public hearing and reviewed the ordinance at their December <br />4, 2003 meeting. During the public hearing, Ron Touchette, a landowner, asked questions <br />regarding how the 25% building lot coverage is applied to existing structures. <br /> <br />The Planning Commission raised concerns regarding the 25% building lot coverage restriction. <br />Discussion ensued to the effect that the proposed 25% building coverage and difference in how <br />maximum building coverage is measure might be limiting to the businesses. The Commission <br />discussed whether it would be appropriate to include language providing the Planning <br />Commission and City Council the ability to allow for situations where an existing business is at <br />the 25% maximum building coverage, but would like to construct a small addition. <br /> <br />If the City Council were inclined to increase the maximum building coverage restriction, staff <br />would suggest remaining at 35% maximum building coverage, as allowed in the B-2. However, <br />measure the 35% restriction as total gross square footage. This would allow a property owner in <br />the H~I district to achieve the same building footprint allowed in the B-2 district, however the <br />City is still able to limit the gross building square footage. <br /> <br />It is staff's opinion that providing for a maximum 35% building coverage would allow most <br />businesses the needed square footage for future additions. The proposed ordinance is an attempt <br />to provide property owners the ability to achieve development on their property, however allow <br />the City Council the ability to review and make decisions about the development based on the <br />future plan for the Highway 10 corridor. <br /> <br />Subsequent to the Planning Commission meeting, staff met with the City Attorney to discuss the <br />proposed H-1 ordinance. The City Attorney will be prepared to address the question related to <br />what the City's exposure is if the City Council adopts the H-1 ordinance. <br /> <br />Recommendation: <br /> <br />The Planning Commission recommend the City Council introduce the H-1 Highway #10 <br />Business District Ordinance subject to reviewing and discussing their concems, which are <br />outline above. <br /> <br />Council Action: <br /> <br />Introduce the H-1 Highway #10 Business District Ordinance, based on discussion. <br /> <br />Reviewed by: <br />Assistant Community Development Director <br /> <br />PC 12.16.03 <br /> <br /> <br />
