9.20.XXX H-1 Highway #10 Business District <br /> <br /> Subdivision 1. Intent. It has been determined that the properties <br />zoned H-1 Highway 10 Business may integral to the future improvement of the U.S. <br />Highway 10 transportation system. Thus, the land within the H-1 Highway district are in <br />a state of transition. The purpose of the H-1 Highway 10 Business District is to allow for <br />development opportunities that will provide minimal impact within said district yet allow <br />for the ability of property owners to utilize their property for economic benefit until such <br />time as the U.S. Highway 10 improvements are initiated. In order to ensure desirable and <br />appropriate development along the Highway 10 corridor, new uses and expanding <br />existing uses will be subject to a Special Use Permit. <br /> <br /> Subdivision 2. Special Use Permits (SUP). Due to the properties located <br />within the H-1 district being in a state of transition a Special Use Permit (SUP) will be <br />required for all new uses and expansion of existing uses. In the event an alteration to an <br />existing use is considered a minor change, as regulated in Subd. 7, the proposed minor <br />change will be reviewed administratively by City Staff. <br /> <br /> Subdivision 3. Standards for Issuance. A Special Use Permit <br />may be granted subject to the City Council making the following findings: <br /> <br />a. Adequate and safe public water and sanitary sewer is available <br /> to the property. <br />b. Will not create an excessive burden on parks, streets, and other <br /> public facilities and utilities, which serve or are proposed to <br /> serve the area. <br />c. The structure and site shall not be altered in appearance so as to <br /> have an adverse effect upon adjacent properties. <br />d. Will not cause traffic hazard or congestion. <br />e. Neighboring land and dwellings will not be adversely affected <br /> because of traffic generation, noise, glare, or other nuisance <br /> characteristics. <br />f. The use and/or size of the use will not be in conflict with the <br /> intent of the H-1 District to provide appropriate development <br /> along the U.S. Highway 10 corridor. <br />g. The use is reasonably related to the overall needs of the City <br /> and the existing land use in the U.S. Highway 10 corridor. <br />h. Any other conditions deemed appropriate for the purpose of <br /> protecting the public health, safety, welfare, and intent of the <br /> H-1 district. <br /> <br /> Subd. 4. Permitted New Uses with a SUP (Subject to Standards <br />established in Subd. 4 and Performance Standards established in §9.10) <br /> <br />Restaurants, cafes, on and off-sale liquor. <br />Private clubs or lodges serving food and beverages. <br /> <br /> <br />
