<br />3)That this authority would provide a funding mechanism that is fair. It establishes a <br />clear relationship between who pays fees and where projects occur, but stops short of <br />the benefit test that sometimes make special assessments vulnerable to legal challenges. <br />It also does not prohibit cities from collecting fees from tax exempt properties within a <br />district. <br /> <br /> <br />4)That this tool allows cities to perform maintenance and reconstruction on schedule. <br />Timely maintenance is essential to preserving streets and thereby protecting taxpayer <br />investments. <br /> <br /> <br />5)That this tool would allow property owners to fund expensive projects by paying <br />relatively small fees over time. The tool could be used to mitigate or eliminate the need <br />for special assessments. <br /> <br />The motion for the adoption of the `foregoing resolution was duly seconded by Councilmember <br />Johns, and upon vote being taken thereon, the following voted in favor thereof: <br /> <br /> Mayor Strommen <br /> Councilmember Riley <br /> Councilmember Johns <br /> Councilmember Backous <br /> Councilmember LeTourneau <br /> Councilmember Tossey <br /> <br />and the following voted against the same: <br /> <br /> Councilmember Kuzma <br /> <br />and the following abstained: <br /> <br /> None <br /> <br />and the following were absent: <br /> <br /> None <br /> <br />Whereupon said resolution was declared duly passed and adopted by the Ramsey City Council <br />this the 11th day of March, 2014. <br /> <br /> <br /> Mayor <br />ATTEST: <br /> <br /> <br /> <br />City Clerk <br />Resolution #14-03-055 <br />Page 2 of 2 <br />
