arbitration, and then it defaults to the Statutory costing method in which Anoka County would <br />levy for the cost. <br />Acting Mayor Backous asked how Anoka County would allocate the costs. He expressed <br />concern with having to pay for one -half of the price based on a two to one vote. <br />Councilmember Kuzma stated Andover agrees with Ramsey that it is Anoka's dam and that is <br />the big issue. <br />Acting Mayor Backous noted this is a ten -year agreement and no one knows today what will <br />happen during ensuing years. <br />Councilmember Kuzma stated there was talk about Ramsey leaving the LRRWMO and joining <br />the Upper Rum River WMO but he does not think that is the direction Ramsey should go. He <br />stated if Ramsey goes on its own, the Fourth Generation Plan could cost up to $100,000. <br />Acting Mayor Backous stated he just wants to assure that Ramsey has protection in place. He <br />felt it was the principle of elected officials entering into an agreement that puts Ramsey's tax <br />dollars into the hands of a two - thirds majority. <br />Councilmember Kuzma stated if Ramsey does not sign the JPA, BWSR would dictate and <br />Ramsey would have no say at all. He explained Ramsey could request another amendment, but <br />this has already been under discussion for six months. <br />Acting Mayor Backous stated he understands why other member cities would not support an <br />amendment, especially if the capital project is within their boundary. <br />City Engineer Westby noted that Page 11, Subdivision 6, addresses the arbitration process and <br />any member can appeal to nonbinding arbitration. <br />City Attorney Langel reviewed JPA language indicating the Anoka County shall appropriate the <br />tax to all properties within the territory of the LRRWMO for which the bonds are issued. This <br />means it will be levied among the three cities the same as any other County tax. <br />Councilmember Johns noted that results in an equal levy. <br />Councilmember Riley asked City Attorney Langel if he was comfortable with the language. <br />City Attorney Langel stated the City wants a veto vote, but that will not occur. He noted the City <br />initially entered into this JPA because it felt it was the best alternative and that may still be the <br />case. The question is how much leverage Ramsey can get with capital projects and as a practical <br />matter, he does not know whether Ramsey can get more than a two - thirds vote with nonbinding <br />arbitration.
