12) That if the total area of disturbance is one (1) acre (43,560 square feet) or greater in size, <br />the Applicant must obtain a Lower Rum River Water Management Organization <br />(LRRWMO) permit prior to any land disturbance activities occur on the Subject Property. <br />13) That, if applicable, the Applicant shall provide the City with a copy of the LRRWMO <br />permit prior to commencing any land disturbance activities on the Subject Property. <br />14) That the Applicant shall provide the City data on the existing and proposed elevations for <br />the Subject Property for review and approval prior to any land disturbance activities <br />commencing. <br />15) That the Applicant will install and maintain Class V gravel, with a minimum depth of two <br />(2) inches, for the expanded outdoor sales/display area on the Subject Property. <br />16) That the Applicant will maintain a twenty (20) foot wide green space corridor adjacent to <br />the public road right of way and the BNSF right of way. <br />17) That the Applicant will install and maintain evergreen shrubs within the green space <br />corridor along the public road right of way to completely screen the alternative surfacing <br />material from ground level view. <br />18) That the Applicant will enter into a Lease Agreement with the City for the portion of the <br />Subject Property that is owned by the City. <br />19) That the Applicant is requesting the interim use permit for a duration of five (5) years. <br />20) That the proposed interim use will/will not result in adverse effects on the public health, <br />safety and welfare of the residents of the City. <br />21) That the proposed use will/will not adversely impact traffic in the area. <br />22) That the proposed use will/will not be dangerous or detrimental to persons residing or <br />working in the vicinity of the use or to the public welfare. <br />23) That the proposed use will/will not substantially or adversely impair the use, enjoyment or <br />market value of surrounding properties. <br />24) That the proposed use will/will not be operated and maintained so as to be harmonious and <br />appropriate in appearance with the existing or intended character of the general vicinity <br />and such use will/will not change the essential character of the area. <br />25) That the proposed use will/will not create additional requirements at public cost for public <br />facilities and services. <br />26) That the proposed use will/will not be detrimental to the economic welfare of the <br />community. <br />Resolution #14-04-067 <br />Page 3 of 4 <br />
