1. All work performed on an SSTS shall be done by an appropriately licensed business, <br />qualified employees or persons exempt from licensing. Construction permit applications <br />shall be submitted by the person doing the individual subsurface sewage treatment system <br />construction on forms provided by the Department and accompanied by required site and <br />design data, and permit fees. <br />2. Construction permits shall only be issued to the person doing the individual sewage <br />treatment system construction. <br />3. Construction permit applications for new and replacement SSTS shall include a <br />management plan for the owner that includes a schedule for septic tank maintenance. <br />4. A construction permit is not required for minor repairs or replacement of damaged or <br />deteriorated components that do not alter the original function, change the treatment <br />capacity, change the location of system components, or otherwise change the original <br />system's design, layout, or function. <br />(b) Operating Permit. An operating permit shall be required of all owners of new holding tanks, Type IV <br />and V systems; Midsize Sewage Treatment System (MSTS) and other SSTS that the Department has <br />determined requires operational oversight. <br />1. Application. Application for an operating permit shall be made on a form provided by the <br />Department. <br />2. Holding Tanks. The owner of holding tanks installed after the effective date of this <br />ordinance shall provide the Department with a copy of a contract with a licensed sewage <br />maintenance business for monitoring and removal of holding tank contents. <br />SEC. 113 - 23 SALE OR TRANSFER OF PROPERTY <br />(a) Certificate of Compliance. A certificate of compliance shall be provided by the seller to the buyer at <br />or before the closing. The certificate of compliance shall indicate that the SSTS is in compliance with <br />the standards adopted by this ordinance. The certificate of compliance shall be filed with the county <br />auditor along with the certificate of real estate value. A copy of the certificate of compliance shall also <br />be filed with the department. If the system is found to be noncompliant the owner shall submit to the <br />department an acceptable replacement plan within 20 days after notification by the department. The <br />replacement plan shall include a construction permit application and a design for the replacement <br />SSTS. Failure to submit and execute an acceptable replacement plan is a violation of this section. <br />(b) Exempt Transactions. The certificate need not be completed if the sale or transfer involves the <br />following circumstances. <br />1. The tract of land is without buildings or contains no dwellings or other building with plumbing <br />fixtures. <br />2. The sale or transfer is exempt from the requirements that a certificate of real estate value be <br />filed with the county auditor, as per Minn. Statute 272.115. <br />3. Any dwellings or other buildings with running water which are connected to a municipal <br />wastewater treatment system. <br />4. The transfer is a foreclosure or tax forfeiture. <br />(c) Sale or Transfer Transactions Occurring Between November 1 and April 30.
