seller shall arrange for sufficient security to be established in the form of an escrow agreement to <br />assure the installation of a complying SSTS. This escrow procedure may be used to allow the <br />transfer of property. In this event, the compliance inspection shall be completed by the following <br />June 1 and, if necessary, a system upgrade be completed and the certificate of compliance be <br />submitted to the department no later than September 30, unless required sooner by section 113 -20 (i) <br />1. <br />(d) Prohibition Against Transfer of Property. No real property in the city shall be transferred unless the <br />parties to the transaction have complied with the requirements of this section. <br />SEC. 113 - 24 VIOLATIONS AND PENALTIES <br />(a) Misdemeanor. Any person who fails to comply with the provisions of this ordinance may be charged <br />with a misdemeanor and upon conviction thereof, shall be punished therefore, as provided by law. A <br />separate offense shall be deemed committed upon each day during or on which a violation occurs or <br />continues. <br />(b) Prosecution. In the event of a violation or a threat of violation of this ordinance, the Department may <br />initiate appropriate actions or proceedings to include injunctive relief to prevent, restrain, correct, or <br />abate such violations or threatened violations; and the City Attorney may initiate a civil action. <br />SECTION 3. SUMMARY <br />The following is the official summary of Ordinance #14 -03, which has been approved by the City Council of <br />the City of Ramsey as clearly informing the public of the intent and effect of the Ordinance. <br />It is the intent and effect of Ordinance # 14 -03 to amend Ramsey, Minnesota City Code Chapter 113, Article II <br />to update subsurface sewage treatment systems (SSTS) regulations, otherwise known as septic systems, in <br />order to remain in compliance with Minnesota Rules 7080 -7083. The ordinance re- arranges existing standards <br />currently within City Code and amends licensing requirements for licensed septic installers and maintainers. <br />The ordinance does not change design requirements for septic systems currently found in City Code. <br />SECTION 4. EFFECTIVE DATE <br />The effective date of this Ordinance is thirty (30) days after its passage and publication, subject to City Charter <br />Section 5.07. <br />Adopted by the Ramsey City Council the 13th day of May, 2014. <br />ATTEST: <br />erk Jo Ann M.
