The amendment proposes to change the land use designation of a 50 -acre property from <br />Rural Development to Mixed Use, adds the property to the Metropolitan Urban Service Area (MUSA), <br />and updates the City's local sewer staging plan. The amendment also changes the City's Mississippi <br />River Critical Area Plan. <br />The Council recommended that the City put the amendment into effect, with no plan modifications, <br />following the Minnesota Department of Natural Resources (DNR) final approval of the Critical Area Plan <br />amendment, and to forward the review report and recommendations to the DNR for review and approval. <br />A copy of the staff report is attached; another copy has been sent to the DNR. <br />Under state laws, only after written approval from the DNR can plans, ordinances, and amendments <br />affecting lands within the Critical Area Corridor be enacted by local units of government and become <br />legally effective. The Council must submit the amendment and an evaluation of the amendment's <br />consistency with regional objectives and Executive Order 79-19 to the DNR within 60 days of receipt. <br />Under the Critical Areas Act, the DNR has forty-five days from receipt of the Council's recommendation <br />to review the amendment for its consistency with Executive Order 79-19 and other state laws. The DNR <br />will contact the City directly. <br />The amendment's information summary and maps will be appended to the City's plan in the Council's <br />files.
