Staff recommended that the developer be responsible for the construction of the <br />intersection and hold him harmless if the intersection needs to be relocated, staff feels that there <br />is some benefit of the intersection other than to the developer, which is why they made their <br />recommendation. <br /> <br />Motion carded. Voting No: None. <br /> <br />Case #3: <br /> <br />Request to Rezone Certain Property from B-1 Business to R-2 Medium <br />Density Residential; Case of Turtle Moon, Inc. <br /> <br />Associate Planner Wald stated that Turtle Moon Inc. is requesting.the City rezone a portion of <br />the proposed Rivenwick 3rd Addition from B-1 Business to 'R-2 Medium Density Residential. <br />The applicant is proposing to develop 112 townhouse units on approximately 19 acres located <br />north of the existing Rivenwick residential development. The project area is zoned a <br />combination of R-2 Medium Residential and B-1 Business. The proposed Rivenwick Td <br />Addition contains Outlot D and Outlot E, which are platted lots that were anticipated to serve as <br />the future alignment of Riverdale Drive when the area developed. Due to the configuration of <br />the proposed townhouse development, Riverdale Drive has been shifted to the nOrth ranging <br />from 40 feet to 90 feet. The total area to be reZoned is approximately 1.82 acres in size. <br />Property located south of the platted outlots (Outlot D and E) is zoned R-2 Medium Density <br />Residential and north of the platted outlots is zoned B-1 Business. The Comprehensive Plan <br />designates the area south of the proposed Riverdale Drive as medium density residential <br />development and north of the outlots is designated as Mixed-Use development. The proposed <br />rezoning is consistent with the Comprehensive Plan as the Comprehensive Plan permits higher <br />density developments to occur in a mixed-use designation. The Planning Commission held a <br />public hearing and reviewed the request at their October 10, 2002 meeting. There was no citizen <br />input during the public hearing. The City Council tabled the rezoning request on November 12, <br />2002, due to the City Council tabling action on the preliminary plat for Rivenwick 3rd Addition in <br />order for staff to gather additional information related to the plat. The Planning Commission <br />recommended that the City Council approve the rezoning request. <br /> <br />Motion by Councilmember Kurak, seconded by Councilmember Strommen, to adopt Resolution <br />#03-01-011 Findings of Fact #0641 relating to a request from Turtle Moon, Inc. to rezone a <br />portion of Outlot B Rivenwick from B-1 Business to R-2 Medium Density Residential. <br /> <br />Motion carded.
