City Engineer Jankowski explained that the road must conform with the state requirements for <br />MSA roads, but they don't have to put concrete curb and gutter along the road, which will help <br />reduce costs. <br /> <br />Mayor Gamec inquired if they would only leave the curb and gutter off near the intersection of <br />Highway #10 and C.R. #56. . <br /> <br />City Engineer Jankowski replied yes. <br /> <br />Councilmember Pearson inquired if they were to approve the plat, would the road have to be <br />constructed prior to any homes being built. <br /> <br />City Engineer Jankowski replied that City Code requires that there be a bituminous access for <br />any unit that receives a certificate of occupancy. <br /> <br />Councilmember Kurak inquired if the City could be dragged into the issue where a property <br />owner's fence encroaches onto the berm located on the developer's property. <br /> <br />City Attorney Goodrich replied that he did not think the City would be involved because the <br />issue has been resolved between the developer and property owner. <br /> <br />Councilmember Zimmerman inquired if the location of the frontage road would line up with a <br />future frontage road through the County Park and in front of Diamonds. <br /> <br />City Engineer Jankowski replied that that location has never been identified, but there is .a <br />commitment on the part of the County for the frontage road to continue. <br /> <br />Motion by Councilmember Kurak, seconded by Councilmember Cook, to adopt Resolution <br />#03-01-010 to approve the preliminary plat of Rivenwick 3~ Addition contingent upon <br />compliance with City staff review letter dated September. 27, 2002, 'revised November 8, 2002, <br />revised January 10, 2003 and the developer receiving a rezoning of that portion of the subject <br />property which is zoned B-1 Business, the fence issue with the neighbor being resolved, <br />occupancy permit not being issued for any units until the road is completely constructed with <br />lights at the intersection Ramsey Boulevard and Highway #10 to approval of the City and <br />MnDOT. <br /> <br />Further discussion: Councilmember Pearson inquired if the City Would have to pay the cost of <br />redoing the intersection of C.R. #56 and Highway #10 in the future if the frontage road is <br />extended. Mayor Gamec replied that they would probably use MSA funds sinCe it is a MSA <br />road. Councilmember Pearson stated that if they alloTM a temporary intersection and then :it has <br />to be redone he would like to know who would have to pay the bill. Councilmember Kurak <br />replied that she did not believe that it would be a temporary intersection. City Engineer <br />Jankowski explained that the intersection of Ramsey Boulevard and Riverdale Drive would need <br />to move 200 feet to the south at an estimated cost of $180,000.
