,City Attorney Goodrich verified that that was correct. <br /> <br />Councilmember Zimmerman inquired if the $52,300 was paid out of TIF. <br />Finance Officer Lund replied that MSA funds were used. <br /> <br />Motion by Councilmember Kurak, seconded by Councilmember Pearson, to authorize the Mayor <br />and City Administrator, on behalf of the City, to 'execute the Settlement Agreement and <br />Easement Agreement with the State of Minnesota by its Commissioner of Pollution Control <br />Agency relating to Sunwood Drive and Azurite Street right-of-way acquisition including the <br />grant of a utility easement in favor of the State of Minnesota for service of the State's utility lines <br />serving its water treatment building. Further the City Attorney is granted the authority to make <br />minor modifications to the form of the Settlement Agreement and/or Easement Agreement. <br /> <br />Motion carded. Voting Yes: Mayor Gamec, Councilmembers Kurak, Pearson, Cook, Elvig, <br />Strommen, and Zimmerman. Voting No: None. <br /> <br />Case #8: Settlement of Ebert Construction/SEH Fire Station II Claims <br /> <br />City Attorney Goodrich stated that in September 2002, the City Council approved an agreement <br />with Short Elliot Hendrickson ("SEH") architects of the Fire Station II project. The settlement <br />provided that the City would pay its outstanding bill with SEH in return for SEH indemnifying <br />the City from any further claims by Ebert 'Construction, the general contractor of the project. <br />SEH and Ebert have now agreed to settle Ebert's outstanding claim by SEH paying .Ebert <br />$8,000.00 on behalf of the City. There is no cost to the City as a result of this settlement. <br /> <br />Motion by Councilmember Cook, seconded by Councilmember Zimmerman, to authorize the. <br />Mayor and City Administrator, on behalf of the City, to execute the Release and Settlement <br />Agreement between Ebert Construction, Short Elliot Hendrickson, Inc. and the City. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Cook, Zimmerman, Elvig, Kurak, <br />Pearson, and Strommen. Voting No: None. <br /> <br />Case #9: Report from Ramsey Town Center Task Force <br /> <br />Principal Planner Trudgeon stated that the Ramsey Town Center Task Force has been meeting <br />since March 21, 2002, to gather information about mixed-use, transit-orientated, pedestrian <br />friendly development. Specifically, the Task Force has been looking at how a "town center" <br />could be developed in Ramsey in the area known as Section 28 and bordered by Anoka County <br />Highways #116 (Industry Boulevard), #56 (Ramsey Boulevard), #83, (Armstrong Boulevard), <br />and the Burlington Northern railroad.
