The significant changes to the ordinance are as follows:

On parcels 2 acres and greater in size, the aCcessory building can be located closer
to the front property line than the home as long as it maintains compliance with
the standard front yard setback, is constructed with the same materials as the
home, and is designed with soffit, fascia and eave overhang like the home.

bo

The height of an accessory building will be regulated by lot size versus whether
the property is in or out of the Metropolitan Urban Service Area. Variance criteria
was also established to vary from the height restrictions,

When the accessory building is within 5 feet of the principal building, adding in
the option to construct the accessory building with a 1-hour fire rated wall instead
of requiring it to be attached to the principal building.

Eliminating the requirement that states accessory buildings within 10 feet of the principal
building must comply with the same setback requirements as the principal building.

Motion by Councilmember Kurak, seconded by Councilmember Pearson, to adopt Ordinance
#03-01 to amend the setbacks and heights for accessory buildings.

A roll call vote was performed by the Recording Secretary:

Councilmember Kurak aye
Councilmember Zimmerman aye
Councilmember Cook absent
Councilmember Pearson aye

City Council/January 28, 2003
