Zoning Bulletin May 25, 2014 I Volume 8 I Issue 10 <br />sponse to Reardon's letter that could be appealed to the board under <br />§§ 8-6(a) and 8-7. As such, the court concluded that Reardon's letter <br />challenging the permits was effectively an untimely appeal from the <br />March 2010 decisions. <br />See also: Holt v. Zoning Bd. of Appeals of Town of Stonington, 114 <br />Conn. App. 13, 968 A.2d 946 (2009). <br />Case Note: <br />In its decision, the court noted that to conclude other than it did "would allow <br />someone to readily circumvent appeal deadlines and create uncertainty in <br />zoning decisions simply by complaining to a zoning official that certain facts <br />or law had not been considered in rendering a previous decision. Moreover, <br />. . . [it] would create a disincentive for zoning officials to consider the merits <br />of citizen complaints, to discuss those merits, and to provide an explanation of <br />the basis for their decisions to interested parties." <br />Case Note: <br />The court also found that § 1101(a) of the Town's zoning regulations did not <br />impose a duty on the ZEO to respond to Reardon's letter, as Reardon had <br />argued. <br />onin News from % rouna; the ation <br />ILLINOIS <br />A bill pending in the State Senate would give the Illinois Depart- <br />ment of Agriculture the ability to regulate the location of wind farms <br />and any other electric -generating wind device. The La Salle County <br />Board has approved sending a resolution to various state politicians to <br />voice their opposition to the bill.
