replat of the property, all 54 lots were designed with the standard drainage and utility easements
around the perimeter. These easements dedicated around the .perimeter of the 54 new lots
conflict with the easements dedicated when the plat consisted of only 3 lots. The process of
replatting does not vacate any pre-existing easements of record. The only way to eliminate
easements of record is by City Council ordinance. City staff recommended introduction of the
ordinance to vacate pre-existing easements in Wildlife Sanctuary,

Citizen Input

Patrick Hampton, 15551 Potassium Street NW, Ramsey, stated that he wanted to see what they
are planning on doing and how it impacts his property.

Community Development Director Frolik explained that the 'plat had already been approved by
the Council, and it includes 54 lots.

Mr. Hampton stated that he wants to make sure that whatever they do does not impact his
property.

Councilmember Cook stated that the development has already received approval. At this time,
they are only looking at vacating easements that are no longer necessary.

Mayor Gamec explained to Mr. Hampton that the City makes sure that drainage from a new
development stays on the property being developed.

Mr. Hampton inquired if the Met Council was forcing the City to develop the high density.

Mayor Gamec replied no.

Mr. Hampton stated that he believes in property rights, but he did not seethe need for developing
high density on a small parcel because it will become a ghetto.
Milt Weichelt, 15407 Nowthen Boulevard NW, Ramsey, stated that he did not understand what
was happening with the vacation of the easement. He inquired if the easement would be replaced
by something else.

Community Development Director Frolik explained that Wildlife Sanctuary was originally
platted as three rural lots and according to City Code each lot is required to have a standard
drainage and utility easements around the perimeter of the lot. Now that the property has been
platted into 50 plus lots, each of these lots will have the standard drainage and utility easements;'
the old easements conflict with the new easements so they have to be vacated.

Jose Alijando, 15641 Potassium Street NW, Ramsey, stated that he was unclear as to what was
happening.

Mayor Gamec replied that he could discuss the issue further with the City Engineer.

Motion by Councilmember Kurak, seconded by .Councilmember Elvig, to close the public
hearing.

City Council/March 25, 2003
