If no <br />reasonable alternative exists, then design and construction <br />must minimize impacts. <br />C. Trails, access paths, and viewing areas. Facilities providing <br />access to or views of the Mississippi River may be placed within <br />the bluff impact zone, shore impact zone, or slope preservation <br />zone if design, construction, and maintenance methods are <br />consistent with the best management practice standards in Trail <br />Planning Design and Development Guidelines, incorporated by <br />reference under part 6106.0090. Trails, paths and viewing areas <br />must be designed and constructed: <br />(1) to minimize visibility from the river and interference with <br />public river corridor views; and <br />(2) to minimize fragmentation of primary conservation areas. <br />D. Water access facilities are subject to the following <br />requirements: <br />(1) watercraft access ramps must comply with chapters 6115 <br />and 6280; and <br />(2) public water access facilities must be designed and <br />constructed consistent with the standards in the Design <br />Handbook for Recreational Boating and Fishing Facilities, <br />incorporated by reference under part 6106.0090. <br />Public trails may be placed in sensitive areas <br />subject to these design guidelines. <br />PART 6106.0140 GENERAL DEVELOPMENT STANDARDS FOR PRIVATE <br />FACILITIES <br />Subp. 1 Purpose. The purpose of this part is to provide design <br />standards for private facilities within the Mississippi River Corridor <br />Critical Area that are consistent with best management practices and <br />will minimize impacts to primary conservation areas and other <br />identified resources. Local government ordinances must be consistent <br />with the standards in this part unless the commissioner approves a <br />flexibility request under part 6106.0070 subp. 6. <br />Design standards for private facilities are <br />described in this part. <br />Subp. 2. General design standards. All private facilities must be <br />developed in accordance with the land alteration, vegetation, and <br />stormwater management requirements in parts 6106.0150 and <br />6106.0160. <br />Subpart 3. Private roads, driveways and parking areas. Private roads, <br />driveways, and parking areas, with the exemptions noted in Table 1, <br />must: <br />A. be designed and constructed to take advantage of natural <br />vegetation and topography to achieve maximum screening from <br />view to minimize visibility; <br />B. comply with structure setback requirements according to part <br />6106.0100; and <br />Private roads, driveways and parking areas <br />must meet structure setbacks from the river <br />and bluffs and cannot be placed in slope <br />preservation zones. <br />Note the exemption in Table 1 for private <br />roads, and conveyance structures serving <br />river dependent uses. <br />Working Draft Rules <br />MRCCA Working Draft Rules — DNR, June 2, 2014 <br />30 <br />Commentary /Rationale for Changes <br />
