Councilmember introduced the following resolution and moved for its adoption: <br />RESOLUTION #14-08-148 <br />A RESOLUTION ADOPTING FINDINGS OF FACT #0932 RELATING TO A REQUEST <br />FROM DIANE MATTSEN FOR A CONDITIONAL USE PERMIT FOR A PRIVATE DOG <br />KENNEL TO MAINTAIN FOUR OR MORE DOGS ON A PARCEL OF PROPERTY <br />WHEREAS, the City of Ramsey has received an application from Diane and David <br />Mattsen, hereinafter referred to as "Applicant," for a conditional use permit to maintain more than <br />three dogs on the property generally known as 5520 140th Lane NW, and legally described as <br />follows: <br />Lot 1, Block 1, Flintwood Hills, Anoka County, Minnesota <br />(the "Subject Property") <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1. That Ramsey City Code Sec. 10-56 allows a maximum of three (3) dogs per parcel and that a <br />conditional use permit is required for four (4) or more dogs. <br />2. That Sec. 10-52 of the Ramsey City Code defines the following: private dog kennels are any <br />place where a dog owner keeps four or more dogs over six months of age on property occupied <br />by the dog owner for residential purposes and where the keeping of such dogs is incidental to <br />the occupancy of the premises, and may include breeding and selling of dogs as a hobby; <br />commercial dog kennels are any place where boarding and/or training is offered to any number <br />of dogs not owned by the owner or occupant of the premises; and a proper enclosure is a <br />securely confined indoors or a securely enclosed and locked pen or structure suitable to prevent <br />the animal from escaping and providing protection from the elements for the dog. <br />3. That the Subject Property and all surrounding parcels are zoned R-1 Residential (MUSA). <br />4. That the Subject Property is approximately 1.28 acres and contains a proper enclosure for dogs <br />that is made up of a chain -link fence and a three (3) foot high privacy fence lining its inside. <br />5. That the Applicant proposes to establish a private dog kennel that will board up to twelve (12) <br />dogs at one time and that each dog will weigh fifteen (15) pounds or less. <br />6. That the Applicant proposes to care for four (4) dogs that they own, provide occasional dog <br />boarding services (dog sitting) for family members without charging for said services, and <br />occasionally breed dogs. <br />7. That the Applicant has obtained support for the conditional use from two (2) neighboring <br />property owners. <br />
