Subd. 3. APS Established. To help the police department better regulate current and <br />future secondhand goods businesses, decrease and stabilize costs associated with the regulation <br />of the secondhand goods industry, and increase identification of criminal activities in the <br />secondhand goods industry through the timely collection and sharing of transaction information, <br />this Section also implements and establishes the use of the automated pawn system (APS). <br /> <br />Subd. 4. License Fee. <br /> <br />The annual license fees for licenses issued under this Section shall be $2,000.00. <br /> <br />The billable transaction license fee shall reflect the cost of processing transactions <br />and other related regulatory expenses as determined by the city council, and shall <br />be reviewed and adjusted, if necessary by resolution. Licensees shall be notified <br />in writing thirty (30) days before any adjustment is implemented. <br /> <br />Billable transaction fees shall be billed monthly and are due and payable within <br />thirty (30) days. Failure to do so is a violation of this Section. <br /> <br />7.94.03 <br /> <br />Exceptions - Secondhand Goods Dealer shall not apply to or include the following: <br /> A. The sale of secondhand goods where all of the following are present. <br /> <br /> 1. The sale is held on property occupied as a dwelling by the seller or owned, <br /> rented or leased by a charitable or political organization; <br /> <br /> 2. The items offered for sale are owned by the occupant; <br /> <br /> 3. That no sale exceeds a period of 96 consecutive hours; <br /> <br /> 4. That no more than four (4) sales are held in any 12 month period; <br /> <br /> 5. That none of the items offered for sale shall have been purchased for resale or <br /> received on consignment for purpose of resale. <br /> <br /> B. The sale of secondhand books or magazines. <br /> <br /> C. The sale of goods at an auction held by an auctioneer. <br /> <br /> D. The business of buying or selling only those secondhand goods taken as part or <br /> full payment for new goods and where such business is incident to and not the <br /> primary business of a person. <br /> <br /> E. A bulk sale of property from a merchant, manufacturer or wholesaler having an <br /> established a place of business or of goods sold at open sale from bankrupt stock. <br /> <br />Goods sold at farmer's market. <br /> <br /> <br />
