Commissioner introduced the following resolution and moved for its adoption: <br />RESOLUTION #14-09-178 <br />RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE TO CONTRUCT A <br />DETACHED ACCESSORY BUILDING THAT ENCROACHES INTO THE REQUIRED <br />SETBACKS FROM THE ORDINARY HIGH WATER MARK OF THE RUM RIVER, <br />THE BLUFF LINE OF THE RUM RIVER, AND THE FRONT PROPERTY LINE AT <br />16601 FLUORINE ST NW AND DECLARING TERMS OF SAME <br />WHEREAS, Kimberly M Barry and Michael R Musenbrock, hereinafter referred to as the <br />"Permittee," have properly applied for a variance from Section 117-256 (District Provisions) and <br />117-111 (R-1 Residential District) of the Ramsey City Code to construct a detached accessory <br />building within the established river, bluff line, and front yard setbacks on the property generally <br />known as 16601 Fluorine St NW and legally described as follows: <br />Lot 8, Block 1, White Pines Estates, Anoka County, Minnesota, subject to easement as <br />shown on the plat <br />(the "Subject Property"). <br />AND WHEREAS, the Planning Commission conducted a public hearing on September 4, <br />2014, pursuant to Section 117-53 of the Ramsey City Code. <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1. That based on Findings of Fact #0934, a Variance to construct a detached accessory building <br />(the "Building") within the required setbacks to the Ordinary High Water Mark (OHWM) of <br />the Rum River, the bluff line of the Rum River, and from the front property line on the Subject <br />Property is hereby granted. <br />2. That the Building shall not be located any closer than sixty-five (65) feet from the OWHM on <br />the Subject Property as shown on Exhibit A, herein incorporated. <br />3. That the Building shall not be located any closer than twenty (20) feet from the bluff line on <br />the Subject Property as shown on Exhibit A. <br />4. That the Building shall not be located any closer than twenty-four (24) feet from the front <br />property line of the Subject Property as shown on Exhibit A. <br />5. That the Permittee shall construct the Building in accordance with all other provisions of City <br />Code Section 117-349 (Accessory Uses and Buildings) including architectural features such <br />as siding and roofing materials to match the principal building, stonework, soffit, fascia, and <br />eave overhangs. <br />
