Councilmember introduced the following resolution and moved for its adoption: <br />RESOLUTION #14-09-175 <br />A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT <br />FOR A PRIVATE AND COMMERCIAL DOG KENNEL TO MAINTAIN A MAXIMUM <br />OF SEVEN DOGS ON A PARCEL OF LAND AT 5520 140th LN NW BASED ON <br />FINDINGS OF FACT #0932 <br />WHEREAS, Diane and David Mattsen, hereinafter referred to as the "Permittee" have <br />properly applied to the City of Ramsey (the "City") for a Conditional Use Permit to maintain up <br />to seven (7) dogs on the property generally known as 5520 140t1 Lane NW and legally described <br />as follows: <br />Lot 1, Block 1, Flintwood Hills, Anoka County, Minnesota <br />(the "Subject Property") <br />WHEREAS, the Planning Commission met on September 4, 2014 and recommended City <br />Council approve/deny the request. <br />NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1. That based on Findings of Fact #0932, a Conditional Use Permit (the "Permit") to maintain <br />up to seven (7) dogs on the Subject Property is hereby granted to the Permittee. <br />2. This Permit shall remain in effect so long as the conditions imposed herein are complied with. <br />3. This Permit shall allow for the maintenance of a maximum of seven (7) dogs on the Subject <br />Property and create two types of dog care operations: a private dog kennel to maintain four <br />(4) dogs owned by the Permittee on the Subject Property and a commercial dog kennel to <br />maintain up to three (3) additional dogs that do not reside on the Subject Property. <br />4. Upon confirmation of any complaints of odor or noise problems relating to the dogs on the <br />Subject Property, the City may take action to abate the nuisance in accordance with Section <br />10-69 (Dogs Disturbing the Peace) of the Ramsey City Code, herein incorporated as reference. <br />5. That the Subject Property shall be maintained in a sanitary condition according to State and <br />local humane standards. <br />6. That no dog under the ownership or supervision of the Permittee shall be allowed to run at <br />large, and at all times the dogs shall be physically controlled by a permanent confinement area <br />or on a leash. <br />
